AT 31 ID- Ix discussing this matter of allow ing restaurants to keep open after midnight, or compelling them to close their doors at that hour as pro vided in section two of ordinance No. 557, it seems to us that one important point has been overlooked. "Without reference to the case to be tried this morning it may be said in general that any business not in itself antag onistic to public morals, safety, or general welfare, can not be bound by restrictive measures of the nature of the ordinance in question. It is gen erally conceded that the question of closing saloons at miduight in this city has been settled. That is some thing that has been definitely de cided. The real question now before the public is, "What is a restaurant?" If a "restaurant" is but another name for a place where one can get a glass of whisky, or wine, etc., then the same'rule should apply to it that applies to places of like nature. But if it is only a place such as the name suggests, where ineals are served to order, or where at any time one can get oysters, chops, etc., then in all - justice we submit that it is impolitic to attempt any curtailment of said business. And here, in our judg ment, is where the whole mat ter hinges. If under the guise of a " restaurant '' the pro prietor carries on the retail sale of wines and liquors, then such place of business comes under the head of saloons and should be treated as a saloon. If it is purely an eating house, then it has a natural and in herent right to do business at any hour of the day or night. It is not clear to our mind in what manner the welfare or morals of this community will be seriously affected by the keep ing open of a place where a man, if he be hungry, 'Ban be fed. Then, again: if Smith complies with the ordinance and closes his saloon at twelve o'clock, it is deci dedly unsatisfactory to him to see Jones next door keep his place open and furnish liquor because he is run ning a "restaurant" It .seems to us that instead of dodging around trying to fix something that won't stay fixed, it would be better to have a square understanding. If a "restaurant" man wants to run a saloon in connec tian with his establishment; if it is generally known and un derstood that a man can get a glass of liquor in his place just the same as at a bar, let the same rule apply to him as to his neighbor. Let him carry on his business in that fashion if he wants to and close at twelve o'clock. If he wants to keep open after that hour and furnish food, tea, coffee, etc., it is his right and privi lege so to do and he should not be molested provided that no liquor be furnished his patrons after the hour prescribed in the ordinance. In this matter as in a good inam' others concerning public propriety, the truth lies between; the golden mean is best to be observed; to take counsel of extremists either way but furnishes food for contention. The city compels saloon keepers to pay $200 a year license and closes their doors at midnight. If "restau rants" can dodge the payment of a license and yet sell more liquor after midnight than the saloons do all day it is manifest injustice to saloon men who pay for the privilege and comply with the law. It is impossible to make- fish of one and flesh of the other. Let the word "restaurant" be defined. Let the man that sells liquor as contemplated in the ordi nance be made to comply with its provisions. Calling his place of busi ness a "restaurant," affects the nature of his" business no more than it he called it a brass foundry or a milli nery store. our railroad, bonanza, cattle, and all other sorts of kings. But some of our poor boys and girls write books too, and get heaps of money for them. Then, too, we have newspaper kings like Bennett He bosses the job of spending a million a year. iiut we forgot the queen's book. Every fam ily should read it.
