THK ASTORIA VIGILANTES.
O.vn of Hie most singular cases in
the annals of jurisprudence termi
nated last Wednesday in Portland. As
far as we are informed it is without
precedent The plaintnT was a man
who had for a brief period been a res
ident of this place. The defendants
were a number of well-known cjti-
seus. The charge was unlawful in
fringement of personal liberty and
illegal infliction of severe punish
meut on the plaintiff by the defen
daflts. It is the first instance, to our
knowledge, where a vigilance com
mittee was sued for damages by one
of those with wbom it had dealt
Usually, the summary nature of such
proceedings renders any appeal to
legal tribunals a matter of total im
possibility on the part of the injured.
Some extraordinary testimony was
elicited during the trial, and the de
fendants were mulcted in the snm of
81000.
Now that the trial is over, it would
be idle to deny that a vigilance com
mittee was in existence in this city
last July; that it seized and whipped
some, sent others awny peaceably but
forcibly, and did what most such or
ganizations do without going to the
dreadful length of taking human life,
Whether the committee was or was
not justified in its action is a question
that the Portland trial did not settle.
It is a matter that has been argued
here a thousand times, and it is to
day an open question. A great many
citizens say that after the fire there
was a lawless element here that could
not be controlled by the ordinary pro
cesses of municipal law: that that ele
ment was a menace of danger, and
that a due regard for the peace of the
cily and the safety of the citizens de
manded that a temporary organiza
tion be effected whose object was to
purge Astoria of those who threat
oned the peace of the city and whose
nature and occupation was in direct
opjwisition to quiet and security. On
the other hand there are a large num
ber of citizens who maintain that at
the time there was no more of that
class than there had been at any previ
oub time, that whatever of pillage, rob
bery or excess that had been commit
ted after the fire had been done bv
men who simply jseized the opportu
nity and who were in no way connect
ed with the class the committee
ostracised; that in seizing, imprison
ing and whipping certain parties, the
vigilance committee went beyond all
justice and took to itself powers that
the occasion in no way justified. In
other words a part of this commnni
ty sympathizes with those who
were sent away from here by the
vigilantes last July; another part of
the community say that the vigilan
tes did right
The unfortunate part of it is that
neither side is willing to concede that
the others have any reapon for their
belief.
It is not essential in a brief news
papor article that we go at length in
to the causes that produced the
effect They are far reaching in
their nature and can be more fairly
dealt with when they produce a fit
ting champion. It is but our
present purpose to say that
there can be nothing gained, there
cjin be no good rasult achieved by
further discussion concerning the
acts of last July. It is unwise to sug
gest "Next lime the committee will
hang, and that will avoid anv possi
bility of court trials." This is not the
right spirit, and deserves severe con
demnation from all right-thinking
men. There should bo no "next
time." There should be no suggestion
of the possibility of its recurrence.
There should be no suggestion of
imaginary circumstances wherein any
means of that sort figure. Vigilance
committees are not born of cool de
liberation, but of urgent necessity.
They are useful in proportion to their
infrequency. There are times when
vigilance committees are unavoidable.
Self-preservation is the first law of
nature, and a man will kill to
keep from being killed, but the occa
sions that demand the existence of a
power that takes the law in its own
hands are very rare. Let us hope
that, it may be long before the neces
sity arises in Astoria. The know!
edge that the spirit exists latent is
however, the most efficacious pre
ventative of any need for its active
manifestation.

dered the following decision in the
case recently reported at the general
land ollice from Washington Tern
tory, in which one Basil was accused
of trespassing and cutting timber un
lawfully on the public lands: The
accused, although a squatter, is right
fully on the land if ho intends to
make a home on it and take it under
the settlement laws -when the land is
snrveyed, and he is allowed to do so,
Whether he is or is not a trespasser
docs not depend on how many trees
he cuts, but on the bona fide charac
ter of the settlement If lie takes up
laud in good faith he is the owner
thereof to all practical purposes, al
though the title may remain in the
government which occasionally suff
ers by the loss of timber cut on pre
tended homestead and pre-emption
claims.
Westebk Montana reports great
excitement over reported gold and
Bilver discoveries in the Coeur
Alene mountains. The mines are
at Eaele City in southern Idaho, and
the usual rush is taking place.
An iron ship has been chartered in
San Francisco to load wheat for
Liverpool at 27s Gd, the lowest figure
freights ever.reached at that port
Minneapolis, Minn., has more than
doubled its population since the last
Federal census was taken. In 1880 it
had 46,000; now it has 93,000.
Peesidexi Arthur has pardoned
Sergeant Mason who tried to shoot
Guiteau.
