An Eastern Opinion
Ahout the time the proposition
in reference to the Astoria lnd
grant was made U "the parties of
the second part," the following
letter was sent to the Reporter
from this city:
Astoria, Oregon, December ll,lS82
To the Editor of the Reporter:'
The State of Oregon and peo
ple, and Astoria Chamber of Com
merce, have repeatedly petitioned
congress to declare forfeited the
unearned and abandoned portion
of the Oregon Central Kailroad
grant, but witlmut result. "Would
vou be so kind as to state -whether
settlement can now be allowed
under the recent decision of the
Secretary of the Interior in the
case of "Wonzel vs. St. Paul, Min
neapolis & Manitoba Tiaflway
company.

Following is the reply:
Settlement and entry is in our
opinion not allowable bylaw with
in the limits of any land grant
where the road was not completed
at the date fixed by statute. The
settlement and entry protect?! by
the act of April 21. 1S7G (3d Sec,
10 Stat., p. 35), is that settlement
and entry which is lequired under
the usual rules and regulations
governing pre-emption and home
stead entries. Such entries, with
in the limits of expired railroad
grants, are declared valid, and pa
tents are to be Issued thereon a
in other cases.
The act is mandator;, and in
its legal effect is a legislative dc
laration of forfeiture of all lauds
within the limits of land grants
where the roads have not been
completed in the time fixed by
the granting acts, so far as such
lands may be claimed by settlers
under the homestead or pre-emp
tion laws.
It is further in legal effect a leg
islative revocation for settlement
purposes of all withdrawals of
lands made for such roads, wheth
er the withdrawals wore originalH
authorized by law or not.
Mr. Carl Schurz, civil service
reformer and editor of the North
ern Pacific railroad company's
New York newspaper, attempted
when secretarv of the iu'oiior to
nullify this act of congrc.-s, but
Secretary Teller, who appeals to
have some respect for the lawa of
his countiyas well as for his own
official character and obligations,
and who is not very much en
gaged in the nullification business
for the benefit of repudiating rail
road companies, has found it to
be his duty to enforce the act his
predecessor ignored.
The decision to which ou refer,
and which was first published in
the October number of the 1U
porter (Wenzcl vs. St. P., M. & M.
railroad company), is a clear and
conclusive statement of the law as
found in the act of 1S70.
AVe apprehend that the law
was the same before the . passage
of that act, particularly as to the
grants of the character of those in
Oregon. The inhibition of set
tlement by a withdrawal of lands
is an incident to a grant; where a
grant fails the incidents fall with
it. The land being freed from the
grant, becomes again public land
by virtue of that fact. It only
wants a little intelligence to sec
and enough integrity to declare
and execute the law. The trouble
was that defaulting railroad com
panies did not want the law ascer
tained or carried out, and as they
ran and apparently owned the
interior department, from the
secrotar3 down, it was not ascer
tained, and it was not carried out.
And now comes the act of
April 21, 1S7G, whjch sweeps out
of the way all the chicanery of
railroad apologists and plainly and
emphatically commands, the de
partment of the interior to respect
the laws and to regard bona fide
entries within the limits of railroad
grants as valid when made in the
usual way after the expiration of
the grants, and issue patents ac
cordingly. Secretary Teller decides that
the words "the expiration of the
grants" mean the dates fixed by
the granting acts for the complet
ion of the road?. "
We see no good reason why
settlers should not present their
claims, under the JJd section of the
act of 1876, in every case of actual
settlement within the limits of
such expired grants.

accumulation of standard silver
dollars in the treasurv roes steadilv

000,000 against which there is
outstanding nearly 71,000,000 in
certificates Of V2,'oOO,O0O silver
dollars in July, one-half went into
the treasury. The weight of
silver coin now in tw. treasurv is
5,084: tons. The receipts of in m-y
compared with those for .! uly,
1S82, show a. falling off of over
$4,250,000. This loss is mainly in
internal revenue receipts, which
the operation of the new tax iaw!
by which the tobacco tax hue
been reduced one-half and certain
other taxes abolished, will explain.
In the custom receipt, there was I
an" increase over last .7 uly of
nearly $1,000,000, caused by a re
duction of duties on merchandise
which was hld in bond until after
July 1, in order to Mtcuru the
benefits of reduced
the new tariff act.

outlined this plan in his statement
to a friend. "While talking- of the
situation, he said thai the present
strike was but a skirmish line in a
light which has been projected by
the Knights of Labor, of which
the brotherhood is a branch'. Ev
ery corporation, or firm, or indi
vidual, who employs a large num
ber of men, are interested in see
ing this movement defeated, for
they know that its suoccss means
the success of the Knights of La
bor, and owing to the great inter
osts involved, the Western Union
cannot and will not give in, no
matter what its loss is or to what
inconvenience the public is put to.
The deplorable accident which
lately befell Chief Justice Waite,
an abrasion of the cuticle caused
by unaccustomed horseback exer
cise illustrates in the case of
that distinguished Jurist the di'fii

tion or head quarters for hind
quarters.
