Has Outlived Its Vacmiiicss.
A veey serious question has
arisen throughout the United
States in regard to the jury sys
tem. Is trial b jury played out?
Is it possible to secure a jury
which will honestly try and deter
mine a case on the evidence pre
sented in court, without fear, favor
or- affection? The fact that all
these questions are being put In
all states of . the Union is prima
facie evidence that the jury system
is corrupt, and that a condition of
things exists in connection with
the courts which threatens the
foundation of social order, li tne
.administration of justice be cor
rupt at the fountain head in the
ijury box what hope is there for
the conservation of personal and
popular rights? Trial by jury
has ever been regarded, in Anglo
Saxon communities, as the bust
possible guarantee of the rights of
individuals against the rich and
powerful. The jury, in times past,
stood between the people and arbi
trary government; and if it had
been corrupt,in not a few instances
in the history of constitutional
development in England, there
would have been an end of civil
liberty and religious toleration.
In this country the foundations
of civil liberty are laid deep and
broad in the constitution, and there
is nothing to dread from arbitrary
government; but there is much to
dread from social and moral dryrot,
w.hich naturally manifests itself,
first of all, in the corruption of
justice by the perversion of the
jury system. The danger to the
social fabric from this cause is not
less fatal than it would be were
the republic menaced bj' imperial
ism. In the latter case, the man
hood of the nation would rise in
its might and brush aside at once
and forever the instruments of
autocracy; but, in the former, the
danger lies in the body ol the
people themselves; is selfcreated,
as it were, and can onlv be eradi
cated by a thorough awakening or
the public conscience, and the in
fliction of stern justice in the case
of all who may be proved to have
been guilty of corruptly influenc
ing juries, or of having been so in
fluenced while actum in the ca-
fit t. -
pacity of a juror. That this
evil has become a great and over
shadowing one is well known to
bench and bar. It is, perhaps,
within the power of the courts,
sustained by a patriotic and pure
minded bar, to destroy it root and
branch; but when we consider the
influence by which the judiciary is
elected all over the Union, and tho
relations of lawyers to their cii
ents,- we are not hopeful of any ef
fective action in this quarter. A
judiciary that is dependent on
popular suffrage for its position is
not going to make war against a
system which might be used, with
crushing effect, to destroy all fu
ture hope of a preferment. If th e
reform, comes at at all, it must
come from the people. -The moral
sense of American citizens must
bearoused to the necessity for re
moving the foul blot of bribery
and corruption from their judicial
system. If the respectable and
conservative element of society
takes this matter in hand, those
actively engaged in the adminis
tration of justice would willingly
co-opcrate; but while 'the best
ciass;Oi citizens remain supine the
evil will grow and intensify.
