Death of James Berry Confession of
His Complicity In the Robbery.
Refuse to Reveal the Names of Ills

At 12:20 p. m. Oct. 22d, James
Berry 3 who by his own confession
was a participant in the TJ. P. train
robbery Sept. 19th, died at the
lluigo House in this city, from gan
grene, superinduced by wounds re
ceived at the time of his capture,
Sundar morning.
During the latter part of the
-night proceeding his death Berry
, confessed to Sheriff Glascock and
Mr. Gaines of the express company
that he was one of ihe six men who
committed the robbery of which
lie (with others) was charged, and
also gave the details of the separa
tion of the party in the wilds of
western Nebraska. The main facts
i:i this statement were atterwards
reiterated in the presence of Mr. J.
A. Glandon, express agent in this
.city. He talked freely of Collins,
(the leader) and Mott, who were
killed at Buffalo station, but was
very reticent in reference to those
yet alive, averring that he did not
intend to ,cgive them away." He,
.however, stated that his partner,
whose name he would not divulge,
.came to Mexico with him and took
a night traiu on the C. A. R. It.
for Chicago.
Berry staled that Collins plan
ned the robbery and was the ac
knowledged leader of the party.
When asked in view of nis ap
proaching death, if he did not re
gret what he had done he replied
that he did not, and, upon the
.question being repeated soon after
ward he said somewhat testilv,
"No, I'll be damned if I do." Tip
to a short time before his disso
lution Barry did not believe that he
was going to die, but seemed to
think that the assertion was made
to induce further revelations upon
.his part. Some further assertions
were, however, made, which is not
deemed advisable to repeat. His
phy? icians, Dr. Russell and Roth
Vell, say that his nervous system
.had never been rallied from the
severe shock received at the time
.of his wounding and capture. His
last hours were marked by little
evidence of physical suffering.
.Sheriff Glascock seemed unremit
ting in his attentions to the prison
ter, doing all in his po.ver to min
ister to his want and maKe him
comfortable, and it was remarked
by those in attendance that Berry
seemed to harbor uo ill will toward
.his captors.
Early yesterday morning a con
veyance was sent for Berry's wife,
but she did not reach town until
tatter his death. Much sympathy
js felt for this lady, who is said to
be a most .excellent woman.

Russell, County Coroner, sum

hearing the testimony .produced the
jury returned as their verdict that

The remains were taken in
.cliarjje by friend. An additional
tfftliction to the family is the fact
that Berry's death was preceded
only a few hours by that of his
aged and respected mother, and
to-day, at Richjbiud churchyard,
the venerable mother and her err
ing son will be consigned, side by
ide, to that dreamless sleep that
lenows no -waking.
