MeGr.ire and AJiuarm Montgomery be and they are hereby appointed a hoard of commissioners to ascertain whether anv and what amount in value of damage will he caused thereby and what amount of benefit will thereby ac crue to the owner or possessor of such ground or improvement upon the lien of such street for which such owner ought to be compensa ted or ought to pay a compensation. Sec 4. All the damages and expenses of widening such street shall be bom or paid by the owner or owners of the lots and blocks abutting on said street, and the commission ers hereby appointed shall assess the same upon such owner or owners pro rata. Sec r. Any owner or owners deeming himself or herself aggrieved by the decision of such board of commissioners shall have the right to appeal from such decision to the Circuit court of the State of Oregon for the county of Clatsop, notice of such appeal to be served upon the Auditor and clerk of the city within thirty days after the filing of the award and decision "hv such commissioners with such auditor antf clerk :is hereinafter provided. Sec. . The said hoard of commissioners shall proceed with the making of such assess ment with all convenant dispatch and file the same :is soon as completed with the auditor and clerk. Sec 7. The Common Council, of the citv of Astoria are of the opinion that the public welfare, and the convenience of the inhabitants of said city requires that Con comly street in that part of said city, as laid out and recorded by John McCIurc be widened : Therefore, The City of Astoria docs ordain asfolloitvt; Sec l. That Coneomly street in that part of the citv of Astoria laid out and recorded by John McClure, be. and the same is hereby widened to the width of sixty feet instead of fifty feet as at present. Sec 2. That the amount of ground neces sary to effect such widening be. and the same is hereby ordered to be taken in equal parts from the lots on each side of said street. Sec 3. That John Ilobson, C. A.
