many homesteaders the time trouble
and expense of a personal trip to the
Land Office, when il becomes desira
ble or necessary to make final proof
for their clulmSi !The new lav,which
is now iti fofce provides that any
party desiring to avail himself of the
provisions of the act must go before
the JudgeoHn his absence,the Clerk,
of any court of record in the county
and State, or district and Territory,
in which the lands are situated, with
his witness, maKe the proof, and take
the affidavits required by law, accor
ding to the prescribed forms. The
jndge or clerk taking the proof, is
required to transmit it with thepropc
fee "and charges to the Register and
Receiver of the Land Office, if the
testimony is taken by the clerk in the
absence "of the judge, he is required
to certify on papers to the absence of
the judge.
The officers of the Land Office are
required to examine the papers thus
madeoutandsent,and If satisfied with
their regularity, and the sufficiency
of the proof,upon the receipt of the
full amount of money due, to issue
tbe proper receipts and make the
required rellirnsi If the officers are
not satisfied with the papers, they
are required to notify the party and
advise him of his rights in the mat
ter. The practical working of the
law in the Walla Walla Land District
will, in our opinion, be confined to
the counties of Walla Walla, Yakima
and Whitman, because the, letter of
the law provides for taking the tes
timony "before the Judge, or, in his
absence,before the clerk of any court
of record of the county and State, or
District and Territory in which the
lands are situated", and the only court
of record in the "District and Terri
tory," is the U. S. District Court,
which holds terms at Walla Walla,
Colfax and Yakima, and has a clerk
at each place. The law may possibly
have been intended to allow the proof
to be taken before the judge or clerk
of any court of record in the county,
in which case the proof could be
taken before the judge or clerk of the
Probate Court, that being the only
Court of record in this Territory be
sides the District Court, recognized
by the Land Department. But in
our opinion, proof taken before a
judge or clerk of the Probate Court,
and sent to the Land Office, wou1d
not be considered good. We hope
we are not wrong in our construction
of the law, and would be happy to
publish a decision of the Department
overruling our opinion.

Cemetery Notice.
The undersigned Sexton of the Astoria Cem
etery, in view of the fact that the cemetery
grounds are now permanently located, wishes
all persons owning lots in the grounds to re
port the number and block to him ; also, all
persons who have buried friends in the
grounds at any time, are requested to ad
dress him through the Post-ollice, or call upon
him at his ollice. and furnish him with a list,
embracing the name of deceased, age, when
buried, the lot or block upon which the
burial was made, and such other information
as will enable him to bring order out of chaos.
