Notice is hereby given that a ballot title for a measure was
received by the Lane County Clerk on August 18, 2016, for in-
clusion in the November 8, 2016 General Election.
The ballot title caption is: Heceta Water District Disso-
lution
An elector may file a petition for review of the ballot title
in the Lane County Circuit Court no later than 5:00 p.m., Au-
gust 29, 2016.
Caption: Heceta Water District Dissolution
Question: Shall the Heceta Water District be dissolved
and all assets and liabilities transferred to the Heceta Water
People's Utility District?
Summary: This measure dissolves the Heceta Water Dis-
trict (District). On May 21, 2013 voters approved formation of
the Heceta Water People's Utility District (PUD) with the same
boundaries as the District.
The voters, inhabitants and water service customers of
the District are the same as those of the PUD.
Both the District and the PUD have legal authority to pro-
vide water service to the same area and inhabitants.
The District Board of Commissioners (Board) has trans-
ferred most District assets and liabilities to the PUD. The Dis-
trict stopped providing water services and the PUD began
providing water services on July 1, 2014. The Board has de-
termined that it is in the public interest to dissolve the District
and transfer remaining assets and liabilities to the PUD.
The Board adopted findings of fact, and a proposed dis-
solution and liquidation plan that is filed with the Lane
County Clerk.
It was necessary for the Board to call this election because
under state law voter approval is required to dissolve the Dis-
trict.
