AN ACT to Create a School District in Ore
gon City.
Section 1. Be it enacted by the Legislative Assembly of the Terri
tory of Oregon, Tliat what is known as the corporation of Oregon
City he, ami the same hereby is made and constituted a school district,
under the restrictions hereinafter mentioned.
Sec. 2. The City Council of said corporation shall have the control,
management, and direction of the common schools in said city, and the
funds thereof, independent of the township or school district in which
the said city may be situated; and shall be entitled to the proportional
amount of school funds to which the number of children between the
ages prescribed by law, will entitle them ; and the said City Council
shall perform the duties of district trustees, and shall have power, by a
vote of the qualified voters of said corporation, or by an ordinance, to
leyy taxes for the support of the city schools; for the building, repair
ing, and hiring of school houses, for the purchase or leasing ground
therefor, for the furnishing thereof, for thcp establishment or increase of
school libraries, and for all other incidental expenses. They shall have
full power to establish graded schools, and order such branches taught
as they tnay deem proper, under such rules and regulations as the said
Council mav, from time to time, ordain.
Si:c. 0. The said City Council may cause a poll-tax of one dollar
to be collected from each and every person entitled to vote at the city
(5 election, and the same shall go to the support of common schools in
Eaid city. o
Sec. 4. The exclusive right, privilege, or franchise of maintaining
and keeping a ferry from any point on the Oregon City claim, to any
point on the west cbank of the Willamette river, is hereby conferred
5 upon the said City Council, until otherwise provided by law; and the
said City Council are hereby authorized to lease said ferry right, privi
lege, or franchise to such person or persons, and for such length of
time, not exceeding one year, as they may deem proper, which said
lease may, from timer' to time, be renewed at the expiration thereof;
and all tolls, or in case of a lease, the proceeds arising therefrom shall
be paid into the city treasury for the support of said schools. The
rates ol toll or ferriage for such ferry, shall be fixed by the board of
county commissioners of Clackamas county, as in other cases of Jerries;
7 ''- ih il, that whenever a school district shall be organized in Linn
City, and a proportionable amount of taxation made and paid in for
the support of the school or schools, the children of said district shall
enjov all the benefits and privileges of said school, and shall be allow
ed to cross and re-cross said ferry free of charge, for the purpose of
attending said school, the same as though though they belonged to the
same distiict.
Si:c. 5? The City Recorder shall furnish the county superintendent,
at least twenty days before the lirst Friday in November of each year,
a report containing the number of scholars within the city corporation,
over four and under twenty-one years of age, how long a school has
been kept in said city the past year, what proportion of the scholars in
the corporation have attended school, and the amount of money paid
to teachers.
; Si:c. C. AW taxes raised by order of the City Council, for the sup
port or maintenance of schools in said city, shall be collected by the
City Marshal, or such person as the said City Council may appoint,
anil the same shall be paid into the city treasury; anil the Marshal or
other person paying money into the city treasury, shall file a duplicate
receipt with the superintendent of the ciiy schools ; and the Marshal
or any other person paying money into the city treasury belonging to
the city school fund, and shall fail to file a duplicate receipt with said
Superintendent within five days after making such payment, shall forfeit
a like amount, to be collected before any justice of the peace in said
citv, and said forfeiture shall likewise go into the city school fund.
Sr.c. 7. There shall be elected by the legal voters in said city, on
the fust" Monday in April next, a City Superintendent of common
schools, who shall hold his office for the term of three years, and until
his successor is duly qualified.
Skc. s. The Superintendent shall qualify within ten days after no
tice of his election, by taking an oath faithfully and impartial!) to dis
charge the duties of his oflice, and to the best of his ability, promote
the interest of the common schools in said city.
' Skc. f. The Superintendent shall have the general supervision and
arrangement of the public schools in said city, and shall, from time to
tinn. corimiunicate to the City Council such matters as he may deem

and complete report of all matters connected with the management,
" arrangement, and expenses of the said schools, together with a list of
the blanches taught, the names of all teachers employed, the names
and ages of all pupils connected with the city schools, and such other
information as he may deem proper.
Skc. 10. The Superintendent shall examine all teachers asking em
ployment in said city schools, upon all branches that he ma) deem
pruper; and no person shall be employed as teacher in said schools,
until such person shall have procured a certificate of qualification from
the Superintendent, and the said Superintendent may, at any time, an
nul suelreertitieate.
Skc. 11. The Superintendent of the city schools shall keep an ac
curate account of all "moneys paid into thcVuv treasury, belonging to
the common schools; and no money belonging to said schools shall be
paid out by the Treasurer, except, upon an" order from the Superinten
dent, ot the city schools.
Si-c. 1-V, The County"' Superintendent shall notify the Superinten
dent of the said city schools, of the amount of money in the county
tieasury or otherwise, belonging to the said citv schools, and noon
receiving said notice lie shall draw an order in favor of the city school
s treasurer, lor the amount belonging to said city schools; and "he shall
charge the amount ot such order to said City Treasurer
Skc. 13. The Legislative Assembly may, at any future time, amend,
alter, or repeal this act, when considerations of public ood or the
wants ot the school district mav require it.

immediately to inform the absent memWs, (except those known to be
unavoidably detained,) that their presence is required to enable the
Council to proceed to business. Should they fail to appear on .such
notice, the members present shall adjourn to the next regular meetin
Avhich may have been established by the Council.
Rule 2. A quotum being present, the Council SIUH proceed, in the
absence of the Mayor and Recorder, to appoint a president pro tern
after which the first business in order, after the roll is called shall be
the reading, by the Recorder, the. rc-ord cf the preceding meeting
which, if not objected to, shall be considered as approved.
Rule 3. The Mayor shall announce at each meeting of the Council
the business in order, agreeable to the following rules, and no business
shaiy.e taken up or considered until the class to which it belongs shall
be declared to be in order, except as provided in rule 27, and Irovidu7
that communications from the Mayor may be read at any time.

Pule 5. The Mayor shall preserve order and decorum; may speak
to points of order in preference to other members, rising from his seat
for that purpose; and shall decide all questions of order subject to an
appeal to the Council by any two members, on which appeal no mem
ber shall speak more than once without leave of the Council.
Rule G. The Mayor shall rise to put a question, but may state it
sitting.
Rule 7. Question shall be distinctly put in this form, to-wit
many as are of the opinion that (as
and after the affirmative voice is expressed, "As many as are of the
contrary opinion, say no." If the Mayor doubt, or a division called
for, the Council shall decide, those of the affirmative of the question
shall first rise, and afterwards those in the negative.
Rule 8. All questions relating to priority of business shall be de
cided without debate.
Rule. 9. When two or more members happen to rise at once, the
Mayor shall name who is first to speak.
Rule 10. Xo member shall shall speak more than twice on tho
same question without leave of the Council, nor more than once until
every member choosing to speak shall have spoken.
Rule 11. "When a question is under debate, no motion shall be
received unless :
1st. To amend.
2nd. To substitute for the original.
-3rd. To refer or commit.
4th. To lay it on the table,
5th. To postpone.
Gth. The previous question.
7th. To adjourn.
"Rule 12. A motion to adjourn shall always be in order except
when once put and voted down, it shall not be in order until some
other business has been taken up; shall always be decided without
debate.
Ki r.;; 13. When any member is about to speak in debate, or deliver
any matter to the Council, he shall rise from his scat ami respectfully
address the Mayor, and shall confine himself to the question in debate,
and avoid personalities.
Rule 14. Kvery member who shall be present when a question is
put, shall votefor or against the same, unless the Council shall excuse
him, or unless he be immediately interested, in which case he shall not
vote; but no member shall be permitted to vote on a. question when a
division is called for, unless present when his name is called in its reg
ular order.
Rulk 15. A member of the Council acting as president pro tan.,
may vote in all cases in which he might vote if not so acting.
Rule 1G. Whenever it shall be decided that the Council go into
the committee of the whole, the Mayor shall leave the chair and appoint
a chairman of the committee of the whole, who shall report the pro
ceedings of the committee.
Rule 17. Xo motion shall be considered unless the same shall be
seconded ; when a motion is seconded, it shall be stated by the Mayor
before debate. It shall be reduced in writing, if desired bv any mem
ber of the Council, but the mover may w-ithdraw it at any time before
a decision or an amendment be made to it.
Rule IS. On motion, in committee of the whole, to rise and rrport,
the question shall be decided without debate.
Rule 10. If the question in debate contain several points, anv
member may have the same devided, but the mover of the question
shall have the right to designate upon which point the vote shall be
first taken.
Rule 20. When a question lias been once decided, it shall be in
order for any member who voted in the majority, to move for a recon
sideration thereof; but no motion for a reconsideration of a vote shall
be made after the ordinance, resolution or act, shall have gone out of
the possession of the board ; and no motion of such reconsideration
shall be made more than once, and provided, the motion to reconsider
is made the same day of the passage of the matter in question.
Rule 21. Upon a division of the Council the names of those who
vote for, and those who vote against a question, shall be entered upon
the minutes when any two members may require it, and in such case, it
shall be the duty of the Recorder to enter on the minutes the names of
the members so calling for a division ; and in all approjirialions of
public money, the yeas and nays shall be called for by the Recorder
and recorded ; and no proposition shall be deemed to be carried unless
four members of the Council, thall have voted on the proposition.
Rule 22. Appointments of officers shall be by ballot, and a majori
ty of the members present of the City Council shall be necessary to
constitute a choice.
Rule 23. All committees shall report the facts in relation to the
matter or subject referred, with their opinion thereon, in writting, and
no report shall be received as the report of a committee, except the
same be signed by a majority of the committee.
Rule 24. All committees shall bo appointed by the Mayor, except
when it may be determined that the election be by ballot in the for
mation of special committees, and if not objected to by-any member
shall be considered as approved by the Council.
Rule 2.3. There shall be, until otherwise ordered by the Council,
five standing committees to consist of three members each :
1st. Committee on Finance.
2d. Committee on School.
3d. Committee on Fire and Water.
4th. Committee on Streets and Public Property.
5th. Committee on Health ami Police.
Rule 20. Xo standing rule or order of the Council shall be rescind
ed c.r suspended except by a vote of two-thirds of the members pres
ent; nor shall the order of business established by the rules of the
Council, be postponed or changed
the members present.
Rile 27. Upon the final passage of every ordinance the question
shall be taken by yens and nays, and shall be enrolled by the
Recorder in a book kept for that purpose.
Rule 28. The previous question, until it is decided, shall preclude
all amendments and debate on tiie main question, and shall be put in
this form, to-wit : "Shall the main question now be put."
Rule 20. All questions shall be put in the order they are moved,
except in filling blanks the longest time and the largest sum shall be
put first.
Rule 30. A member called to order shall immediately sit down
unles.H permitted to explain, and the Council, if appealed to, shall decide
on the case, but without debate. If there be no appeal the decision of
the president shall be submitted to.
Rule 31. A motion to lay on the table shaH be decided without
debate.
Rule 32. The Mayor shall cause the Recorder to make a list of
the ordinances, reports, resolutions or other business on the table
which snail be considered "-reports
