in. To prevent, and remove all obstructions irom the streets, cross

plankinpr, paving, cleaning and repairing the cross and side-walks,
either at the expense of property holders, or by appropriations from
the general funds of the city, o
1 4. To appropriate for any item of city expenditure, and to provide
for the payment of the debtand expenses of the city.
lo. Tq erect market-houses, establish and locate lnarkets'and market-places,
and slaughter-houses, an.l provide for the regulation thereof.
1G. To erect, or provide a work-house, or house of correction, and
city prison ami provide for the regulation and government thereof.
17. To regulaie the storage of gunpowder and other combustible
materials, and the uc of Tighs in shops, stable, and other places; to
prevent, remove, or secure anv fire-places, stove, chimney, oven, boiler,
pipe, or other apparatus, dangerous in causing fires.
IS. To prevent and restrain any riot, nois, disturbance, or disor
derly conduct, cr any indecent or immoral practices within the limits
of said city.
10. To impose fines, forfeitures and penalties for the breach of any
ordinance; Provided, That no fine shall, exceed one hundred dollars,
and no offender shall be imprisoned for a longer term than thirty day
for any 'one offence.
20. o To establish and regulate the fees of all officers of said corpor
ation, except where the' are otherwise regulated in this act of incor
poration.0 21. Generally to do all things which a city corporation can or ought,
to secure the health, peace, and interest of the citizens of said corpora
tionpand to preserve good order within the same.
S;:r. 3. AH demands and accounts against the city, shall be audited
by the Council, and prd by the Treasurer, only on a warrant signed
bv thvOIayor, and attested by the Kecordcr.
SkQ 4. The City Council shall have power, if authorized to do so
by a majority of all the electors of said town, at any election held for
that purpose under the direction of the Council, to lev- a special tax
in addition to the taxes authorized to be collected by virtue of this

act, for any purpose or purposes, but public notice of such election, the
object thereof, arid amount required for such purpose or purposes, shall
be giveuvby porting up written or printed notices thereof in six of the
jiio-t public places in said city, at least fifteen days before the time of
holding such election.
Si:c. .3. The City Council shall have exclusive control and direction
:';? all funds collected under general laws, for the improvement of roads
and f-treets within said corporation, and the street commissioner shall
perfbrnrthe duties of supervisor, as required by the general laws of
this Territory relating to roads and highways, but shall report to and
be under the direction of said City Council, and not to the board of
County Commissioners of said county of Clackamas.

Si:c. 1. The Marshal shall receive the same fees for his services as
constables areentitled to by law for those of a similar nature, and for
other services such compensation as maye bo allowed by the City
Council.
S !:. 2. All other officers provided for by this act or to be created,
shall receive such compensation as' may be provided by ordinance.

Ski. 1. It shall be the duty of the flavor to communicate to the

Skc. 2. The Recorder shall reside within the limits of the city; he
shall possess and exercise vithin said city all the privileges, powers,
duties and jurisdiction, civil and criminal, of a justice of the peace of

the duties of such, and shall perform such other duties as may be
ri quired of him by the City Council. It shall also be his duty to attend

Srv. 4. It sffall be the duty of the Assessor, in addition to the
dutus prescribed by the City Council, to make out on or before the
fu st Monday in June of each year, a correct list of all the real estate
within said city, and the personal estate of all citizens thereof, with the
valuation thereof, which he shall certify and return to the City' Council,
said list and valuation shall be made in ths manner prescribed by law
for assessing and collecting county and Territorial taxes. Should the
owner of any property assessed not be satisfied with such valuation
thereof; he uVk? apply to the City Council for a reduction of the ame
bating his reasoius therefor under oath, before the 20th of June in each

and the City Collector shall possess and is hereby vested, wth the same
powers and authority to collect and compel payment of city taxes and
licenses neglected or refused to be paid, by distress and sale or other
wise, which now is or hereafter may be vested in any Sheriff or other
collecting officer, b' law for the collection of county and Territorial
taxes, and in case of the sale of real estate being so sold, the "Recorder
shall have power to make deeds therefor in the same manner that
county auditors are authorized by the laws of this Territory to make
deeds for lands sold for taxes by the county collector.
Sec. S. It shall be the duty of the City Treasurer to receive all
moneys that shall come to said city by taxation or otherwise, and
pay out the same as provided by this act, and at the close of each
and every year, make out and present to the Council, a fair and accu
rate schedule of the receipts, disbursements and expenditures of the
preceding year, which the Council shall publish in some newspaper
printed in said corporation, or otherwise have posted in three public
places therein. The books and accounts of the Treasurer shall at all
times be open to the inspection of any member of the City Council.
Skc. 9. It shall be the cjuty of the City Attorney to attend to all
suits, matters and things, in which the city may be legally interested;
give his advice and opinion in writing when required by the Mayor or
City Council, and attend to the prosecution of all offenders against the
city ordinances before, the Mayor or Recorder.
Skc. 10. The duties of all officers not defined in this act may be
prescribed by the City Council.
ARTICLE VII.
.STIJKETS AND IMl'KOV K ME NTS.
Skc. 1. "Whenever the City Council shall deem it expedient to open,
alter, improve or repair any street or alley, or parts of streets or alleys,
notice thereof shall be given by publication in some newspaper published
in the city. Should the owners of one-half of the adjacent property
protest against the proposed improvement or repair, it shall not then
be made. All such protests shall be made in writting and addressed
to the City Council, and shall be made within ten days after such pub
lishment. If no such protest be made, the City Council shall proceed
with such improvement and repair, at least two-thirds of the expenses
of which shall be borne by the adjacent property, and when the owner
of two-thirds of the property situate on or adjacent to any public street,
if the width or depth of a block or more, shall petition to the City
Council in writing to have the same improved or repaired, the same
shall be done on such terms as the City Council may determine, at
least two thirds of the expenses of

Sec. 1. Xo by-laws or ordinances of said city shall take effect or j
be in force until a copy of the same shall have been posted up, at least,
six davs, in three of the most public places in said corporation, or pub
lished in some newspaper printed in said county of Clackamas.
Sec. 2. That all officers or persons to whom the receipt or ex
penditures of the moneys or funds of the city shall be intrusted
shall give security, in such amount as the City Council may require,
bv bonl, paj'able to the city, and the security shall be subject to
t'te approval of the Mayor.
Sec. 3. All officers required to be elected under this charter, and
the collector, shall, before entering upon the duties of their offices, take
to the following effect: That he
of his skill and ability, discharge the duties of (naming the office to
which, he is entitled) during his continuance therein ; and the Recorder,
in addition thereto, shall take the oath or affirmation prescribed for
Justices of the Peace, which oath shall be reduced to writing, signed
bv the person taking the same, and certified by the officer administer
ing the oath or affirmation, and filed with the records of the City
Council.
Sec. 4. The act passed by the Legislative Assembly, January 00,
18-34, to create a school district in Oregon Cit', is hereby continued in
force; Provided, hoircvcr. That no scholar shall be allowed to attend
the city school in said city whose parents or guardians are not residents
of said city, except by permission of the City Council, and upon pay
ment of such sum as the said Council may order.
Skc. 5. All acts and parts ot acts inconsistent with this act arc
hereby repealed.
Sec. G. This act shall take effect and be in force from and after its
passage; Provided, Zioircver, That the present officers of said city shall
continue in office till their successors are elected and qualified.

AX ACT to Define tbe Powers and Limit the Liability of Oregon City.
Si:cTiox 1. Je it enacted by the Lfjishitive Assembly of tlie State
of Oreaon, That the City Council of Oregon City, in addition to pow
ers now conferred by law, shall possess the following:
1. To remove persons affected with contagious diseases from tlie
limits of the corporation, to suitable hospitals provided by the city for
that purpose. ...
2. To require persons sentenced to imprisonment under any ordi
nance of said citv, as a punishment for crime or for failure to pay any
fine to labor upon the streets of said corporation during the term of
such imprisonment; Provided, That persons confined for non-payment
of nnv tine and costs, shall be credited on the same two dollars for each
day's" labor until such line and costs may be paid, or otherwise dis
charged. 3. " To provide foi the survey of the blocks and streets ot the city,
and for making and establishing the boundary lines of such blocks and
streets. . .....
4. To-abatc anv tax levied by the corporation, appl ical ion therefor
bcincc filed in writ milt with the Recorder on or before the first, day of

i"i-:a 2. Said City Council shall not issue any license to anj' female
to sell spirituous and mall liquors within said corporation.
Sec. 3. The City Council may, if they deem proper, direct the ex
penditure of a portion of the road tax collected within said city, upon
roads outside of said corporation, under the supervision of the Street
Commisser. v
Sec. 4. Said city shall not be liable tn any one for any loss or injury
to person or property, growing out of any easuality or accident hap
pening to such p4Mson or property on account of the condition of any
strector public ground tisercin ;"but this section shall not exonerate
anv oflicer of thecitv or other person from such liability, when such eas
uality or accident is caused by the willful neglect of duty enjoined upon
sm-h"ottic.er Vrr person by law, or by the gross negligence or willful
rmoinduct of such officer or person in any other respect.
