AW ACT to Incorporate Oregon City.
ARTICLE I.
Section 1. He it enacted by the Legislative Assembly of the Terri
tory of Oregon, Thatcso much of the county of Clackamas as is known
as the Oregon City Claim, as laiil out by the late John McLoughlin,
excepting the island known as Abenicthy's islaixl, be and the same is
hereby erected into and constituted a city corporation, known by the
name and style of Oregon City.
Sec. 2. The Mayorllecorder, and City Council hereinafter provided
for, shall be a body corporate and politic, with perpetual succession,
to be known and designated by tlie name and title of the "City
Council of Oregon City," and shall be capable in their corporate name
and capacity, to acquire for the use and benefit, of said corporation,
property, real, personal ami mixed, and are empowered to lease, sell,
ami convey the same; they may have a common seal, which they may
alter, break, amend, or renew at pleasure; may sue and be sued, plead
and be impleaded, defend ami be defended, in any court of competent
jurisdiction, whether in law or in chancery, and generally to exercise
the powt-rs and privileges hereinafter bestowed ; Provided, That prop
ert v purchased outside of said corporation limits shall only be used for
some of the following purposes:
1. For the burial of the dead.
2. For the erection and establishment of a hospital for the reception
of persons afflicted with contagious or other diseases.
3. For work-houses or houses of correction.
4. For the erection of water-works, to supply said city with good
and wholesome water.
ARTICLE II.
DOF Tilt: CITY OFFIC EH3.
Section- 1. There shall be annually eU-cted for the government of
said citv, in the manner hi reinafter prescribed, the following officers:
A flavor, Uecoider, seven Cotincilnien, a Treasurer, and an Assessor,
who shall be collector, a City Attorney and .Marshal, who shall sever
ally hold their offices for one year, or until their successors shall be
elected and qualtlied.
Sec. 2. The City Council may, from time to time, appoint such
other subordinate officers as they may deem necessary and propert
who shall hold their offices at the will of the Council.
5 ARTICLE III.
OF ELECTION'S.
Section 1. A general election for all the officers of said corpora
tion, required to be elected under this act,0 shall be held on the first
Monday of May in each year.
Sec. 2. All person who have resided in the corporation three
months next preceding any election therein, ami shall have the qualifica
tions of an elector of Territorial officers, shall be eutitled to a vote.
0 Sec. 3. No person shall be elected to any office in said city, who
shall not be a qualilied voter under this charter.
SfcC. 4. At all elections for any city officers, the vote shall be by
ballot at the time and place designated by the City Council.
Sec. 5. It shall be the duty of the Recorder, at least te'n days
before each and every annual election, to cause notice of the same to
be posted up in at hast three of the most public places in said corpor
ation. Sec. G. At all elections held by virtue of this act, the polls shall be
opened at the hour of 9 a. m., and kept open continuously till 4 r. jr.
The Recorder shall be clerk of elections, and two or more members of
the City Council shall he .appointed to act a judges of election; and
at the close of the polls, the votes serial I be canvassed and counted by
the judges in the presence of such of the electors as choose to be pres.
cut, and an accurate statement of thecresu!t shall be proclaimed, in an
audible voice, to the electors present," by one of the judges, and the
Recorder shall make a true record thereof, and within threedays there
after, shall give notice to the persons so chosen, of their election.
Sec. 7. The person who shall have received the highest number of
votes for any of lice, shall be declared elected ; Provided, That any
person desiring, may contest said election, by appealing to the City
Council, whose decision shall be final in all cases of contested elections.
Six. S. When a vacancy in any office in said corj oration shall oc
cur by death, resignation, removal, or otherwise, the same may be filled
by the City Council. Every office shall be deemed vacant when the
incumbent shall be absent from the city sixty davs, or when any per
son elected shall fiiil to qualify within ten days alter his election.
Sec. 9. All provisions of law, now or hereafter, 'regulating general
elections, shall apply to and govern, so far as practicable, all elections
to be made under this charter, as hereinbefore provided.
ARTICLE IV.
OF THE ORGANIZATION" AND POWERS OF THE CITV COUNCIL.
Section" 1. The City Council shall fix the time and place of holding
stated meetings, but may be convened by the .Mayor at any time. A
majority of the members shall constitute a quorum to do business, but
a saialh r number may adj urn from time to time,and compel the atten
dance of absent, members, in such manner, and under such penalties as
may have been previously pr scribed. They may adopt by-laws to
j-govcrn their proceedings? .-punish
aP any cmeet ing of the Council, and by a vote of two-thirds of the
whole Council, expel any member. Their proceedings shall be public,
and at the desire of any two members, the "Yeas"' and "Xays" shall
be taken on any question, ami entered on the journal.
Sec. 2. The City Council shall have power within said corporation.
1. To make by-laws and ordinances, not repugnant to the constitu
tion and laws of the LTnited States, or laws of this Territory, necessary
to carry into t-ftVet the provisions of this i barter.
2. q levy and collect taxe for general corporation purposes, not
to exceed one-half of one per centum per annum, upon all real and
personal property actually within the corporate limits of said city,
made taxable by law lor county and Territorial purposes.
3. 1 o make regulations to ire"ent the introduction of contagious
diseases into the city, and for securing the protection, health, cleanli
ness, ornament, peace and goo.or.ler of the city.
0 4. To prevent and lemove nuisances.
5.0 To erect water works, either within or beyond corporation limits.
6. To license, tax, and regulate auctioneers, taverns, hawkers, ped
dlers, brokers, and pawnbrokers, and fix the rate thereof.
