Board ol Equalization. consNtinjr of three
members to be elected in Joint Conven
tion of ihe Legislative Assembly of the
present session, and in cie they f:tl to
elect said Hoard ot Ivjuailz ition shall be
appointed by the G.i verunr. The ni'Tn
bers ot said Hoard shall hold their office
fur the teim of lour years, and until their
successors are elected and qualified : Pro
viding, however, that the Governor for
cause may at any time remove either of
the members ot said Hoard.
Six. 2. The members of said Hoard,
before entering upon the di-charire of
their duties, shall take and subscribe an
oath of uiii'je. as follows : "I, ,
do solemnly swear that I will support the
Constitution of the United States, t tie Con
stitution of the .State of Oregon, and that
I will faithfully and impartially discharge
tlie duties imposed upon me by law as k
member of the Hoard of Equalization for
the State of Oregon;" w hich oath shall be
filed with the Secretary of State.

the ccpital of the the State, on the second
Monday of September, in each year, and
remain in session until the business that
may propel ly come before it is properly
di.-poed of. A majority of the Hoard

and collectors of the revenue in this State
perform their duties, and it there is rea
sonable cause to believe that any asftssor
or collector has failed or refused to per
form any of the duties imposed upon him
by law, then said Hoard shall at once
make, a thorough investigation of the
matter, and if. a.'ter such iuvi siigation. it
appears to said Hoard that such officer Iris
fail.'d or refused to fully discharge the
duties i,f his oRice. the Hoard shall certify
Ihe fact to the District attorney of the
district including the county in which the
duties of such ol.Mcer should b performed,
with instructions to such district attorney--to
institute aga:n-t such officer the legal
proceedings iii.it such officer rivs rendered
himself liable to by reason, of such failure
or refusal, and it shall be the tltity of the
district attorney to obey such instruction.
