A iufneient contest affidavit having been
filed In this office by Hern hard Pundt, contestant
against Homestead eatry No, 13G1H, made May
31, 1904, for NW! Section 20, Township 2 N.
Kange 27 E. W, M., by John H. Gates, Contestee,
in which It Is alleged that said John H. Cates
has wholly abandoned said homestead for more
than six months last past, and lias failed to cul
tivate and improve the same as reqirired by law,
and that said alleged absence from the said
land was not due to his employment in the
Army. Navy, or Marine Corps of the United
States as a private soldier, otllcer, seaman or
marine during the war with Bpain or during
any other war in which the L'uited htates may
be engaged.
Bald parties are hereby notified to appear, re
spond and oiler evidence touching said allega
tion at lOo'clock a.m., on May 2S, r.K)8, before
Joe H. Parkes, a Notary Public, at his ollice at
Pendleton, Oregon, and that final hearing will
be held at 1(1 o cluck a. m., on June 3, lmjH, bv
fore the Register and Receiver at the United
States Land Office in LaGrande, Oresroii.
The said contestant having, in a proper
affidavit, filed April 14, 1908. sot forth facts
which show that after die diligence personal
service of this notice can not be made, it is
hcrebv ordered and directed that such notice
be given by due and ptoper publication.
