filed in this office by Bernhard Pundt, contestant
against Homestead entry No, 13619, made May.
81, 1904, for NWJ4 Section 20, Township 2 Nv
Range 27 E. W, M , by Jofih H. Cates, Contesteer
in which it Is alleged that said John H. Cates
hns wholly abandoned said homestead for more
than six months last past, and lias failed to cul
tivate and improve the same ss required hy law,
and that said alleged absence from the said)
land was not due t j his employment in the
Army. Navy, or Marine Corps of the United
States as a private soldier, officer, seaman or
marlue during the war with Spain or during
any other war In which the United f-tatcs may
be engaged.
Said parties are hereby notified to appear, rcj
spond and offer evidence touching ssid allega
tion at lOo'clock a. m., on May 28, l'.K'H, before
Joe H. Parkes, a Notary Public, at his office at
Pendleton, Oregon, and that final hearing will
be held at 10 o'clock a. in., on June 3, IK18, be
fore the Register and Receiver at the United
States Land Ollice in LaGrande, Oregon.
The said contestant having, in a proper
affidavit, filed April 14, 190s. Set forth facts
which show that after dne diligence personal
service of this notice can not be made, it Is
hereby ordered and directed that such notice
be given by due and proper publication.
