This question is the subject o f a notable paper in the current num­ ber o f the Century Magazine. The writer, omitting the usual and use­ less historical disquisition, cuts with a trenchant blade into the very core o f the question. H e premises that the distinctive features of the ju ry system are that we take jurymen to sit as judges in our Courts who have neither training nor experience for their wo» k ; we take new men each day ; and we select them by lot. In a!! blanches of business, and in all thoother departments o f go v­ ernment, men are chosen, theoreti­ cally at least, in view of their experi­ ence or fitness for the work they are to do. I t is only in our tribunals for the settlement o f disputes that we reverse this principle o f selection and introduce the element o f chanco. Some persons are quite convinced that the ju ry is not a perfect tri­ bunal for getting wise decrees, yet have a doubt whether we can get anything better to take its place ; others think we may possibly frame something better than our ju iy sys­ tem, looking at it merely as a part of the machinery o f justice, yet have a belief that we must keep it as a bulwark o f our liberties; others think that the ju ry system has great value as a means to the polit­ ical education o f the peoDle; others believe that it is only one organ in a large organism, and that an at­ tempt to make any great change in one organ w ill endanger the health or the existence of the whole organ ism. I t is to combat these views, that the writer in question devotes his article. There can be no sort of doubt that the ju ry system, as now con­ stituted, has in a great measure lost its ancient place in the public es­ teem. People generally are dissat­ isfied with it, y e t ciing to it, partly out o f pure conservatism, and partly because nothing lias been proposed as a substitute that is not open to criticism. This Magazine writer would have juries abolished, and causes tried, both as to law and fact, by a bench of jhdges learned in the law. There is a wide- spread and, we may add, a well grounded disinclination to entrust the decision of civil disputes solely to judges of the law. 11 is conceived to be true, and it is true, that the judicial mind, by virtue of its pro- feasional training, runs in a groove to itself. The law is severoly logi­ cal, and the lawyer-judge is prone to follow its nice and subtle dis­ tinctions away from the regions of practical justice into the realm of fine-pointed technicalities. Causes must be tried, it is true, upon exact principles. Y e t it is desirable that these .principles should be broad enough to embrace the ordinary a f­ fairs o f men. The whole tendency o f judicial decisions is toward a purely intellectual ratiocination. The jury has, against this tendency, acted ns a brake. Unused to make the nice distinctions* which the Court makes in his instructions, and often not comprehending them, it sometimes cuts the Oordian knot by ignoring them altogethcr.anddccides the cause upon what it may deem principles of natural justice. Tho Polk county farmer, like tho rest of them in the State, is oppoeed to monopo­ lies, but, unlike the others, they will not ouly receive a monopoly with open arms, but will give them all the aid and comfort possible, until they are bound hand and foot, and then they’ll torn and curse the monopoly. M y reasons for writing the above, are these: A t the rate wheat is quoted in Liverpool, and the price paid for tonnage in Portland to-day, wheat ought, and would be worth here at least ninety cents. Why, then, will it only bring seventy-live cental ltecause the majority of the wheat is stored in the warehouses belonging to the wheat ring iu Portland. One man, representing the Portland wheat-buyers, built warehouses from Airlie to Portland, Mid from Portland to Lebanon ; and they have now the farmers’ wheat in their houses, to be used as needed. They are sure of getting it when needed, and there fore there is no rivalry between them. Heretofore, when wheat was stored in the warehouses belonging to a dozen d if­ ferent merchants, there was a rivalry, and very often they would bid up amongst themselves, and force the Portland mer­ chants to raise the price ; or, when they stored it in the Farmers’ Warehouse, they were sure the wheat was there until the money was paid ; but now there is no merchant to force the market, as the wheat is in the warehouses of the Portland ring. There is no use denying it, an agree­ ment exists between them not to run against each ether; but rather, in case one firm needs wheat badly, the others will lean it to them from the combination warehouses. I f any body doubts it, let him go to Portland and try to sell wheat. The offer of one is the offer of all. There is a combination, and they own the ware­ houses, all denials to tho contrary not­ withstanding. A few years ago the farm­ ers built here, and at other places, large warehouses. W hy have some of them quit hauling to them? Because they saved ten or fifteen miles; but that they now have to take fifteen cents per bushel less, they don’t take into consideration.
