made. As often have we given proof
as to tbe truthfulness of our assertions

istration of county affairs is decidedly
mixed so fur as concerns the two uolH
Ical parties in the matter of the polit
cal complexion of those who are hold
ing office. The sheriff, clerk and treas
urer and one county commissioner
are democrats, but their influence
and their work have .been and are
venly balanced by the majority of
republicans who sit in the couuty and
-commiMiioners' court one judge and
one commissioner. From the com
mencement of the work of the present
mixed admiulstiation there has been
n evidenced pnrpot on the part of
-every officeholder to cut down expen-
: seS, an 1 economically administer
county affairs. The targe and burden
some couuty debt, which began with
the black mud swindle of $1.j,iO0 and
which confronted the present office
holders iu the shape of a heavy load
to: begin with, indepeudent- of the
trouble to direct and provide for the
expenses to accompany another tear's
work, has been wiped out of existence.
This was promised for the mixed
administration before its election by

What other county in the State ia
there to-dy under partisan manage
ment can boast of this much 7 There
is not one in all Oregon. Where is

five veais of local government done

the history of ths county before when

Is noihing in comparison to the pre
ent. That was a time before unscup-
olous democrats and unscrupulous
republicans were allowed to form

which cared more for pelf than prin-

tht county have existence.
But the mixed administration is
the honest choice of the people who
voted for every member of it bei-ause
they believed each member wi au
honest and capable man. That th
rrsutis are gratifying is proof of the
wisdom and xood jiulgmeut of the peo
' pie wheu they are left free to act for
- themselves, and rt not trammeled in
1 their utterances or driven to the poll
to vote as so many sheep to the
slaughter by the com maud of party
leaders. It is further proof that when
the people are their own masters they
generally have what thy most de
ire to coma about to suit their own

leaders pick out the cfandiJates for
them to elect to office?? ! The man
who would argue that I the power of
nomination must exist in party lead
ers, asserts that the American peo
ple are incapable of thinking for
themselves, and to Mil intents and
purposes contends that the matter of
government for the people by the
people is sheer nonsense, and should
never be thought of by the people. It
is the duty of independents to oppose
all such reasonera as would argue
that they must have a master to ar
gue and reason and act for them, as
the democratic and republican leaders
in this cou'uty claim they have a
right They should do as they did
nearly two years ago. They made a
venture then and it was a profitable
one. The work is to done again, and
all to be performed by them. Let
them again make the effort, and turn
ing a deaf eir to the party managers,
assert their freedom which gives them
a right to think and acti for them
selves. ;
BE ABOVE SUSPICION.
It is a matter of amusement to see
how the members of the Roseburg
ring is now working in its efforts to
secure control of the county at the
next election, supported, as It is clear
ly to be seen, by its two papers both
eakly. Jn the first place, we hear
democrats agreeing for the uomina
Hon of a republican now holding
public position for the nlace of con
gressman for Oregon.' Again, we hear
the same democrats urging the nom
ination of another republican for office
arguing that said republican will defeat
certain democrat ! How much love
for parly is there in all such proceed
ings ? Woul J not a man of common
sense say mat such democrats were
democrats for the time being, and be
cause they can thus serve their own
private ends, and would not a man
with the intelligence mentioned be-
live that such democrats are more de
sirous of pocketing a dollar or two,
ot two or three thousand dollars, than
to work the promotion of, a priuciple
of an honest paity ? For our part we
cannot be otherwise than suspicious of
candidate for the nomination for
congress on the republican ticket who
finds advocates before the1 nomination
on the democratic side of the house,
nor have we anything otherwise than
suspicion of the another candidate.
It looks strange, at least, when such
men are the choice of democrats, and
such democrats are members of a cor
rupt political ring. In this writing il
is not our purpose to pen our thoughts
in Greek or to write in Latin. Plain
English suits our purpose best. And
our purpose is to benefit both the can.
didatea named. We but speak for the
great public which looks upon the
ring as dishonest and its candidates
as having the support of dishonest
men. It mailers not how honest the
candidates may be, the f tct of the
class of their: supporters is regarded as
a bad omen. It would be far better
that all candidates should declare they
despise the ring and want none of iu
support, if they desire election to
office. A worse reputation could
not be given a man in Douglas county
to-day than that he is a Fink man and
the ring's candidate. !

county. At Portland two men were
killed, at La Center three children

Prof. Klinkerfns, of (iottiugen, ridi
cules the notion, to which he assigns
an English origin, of the danger to
the earth of the present position of
Juplte , S.iturn, Uranus aDd Neptune.
He scouts the idea of the epidemics of
tnesixttiaiiusix'entn centuries being
caused by a similar phenomenon, de
claring that such a phenomenon did
not then'oucur, and can ! only occur,
even excluding Neptuue, once in 420
years. .;: .
The Pacific Coast hop crop was esti
mated by good judges to ; amount to
about 10,000 to 11,000 bales for the year
1879.. Up to Dec. 1, 1879, 8,383 bales
of hops had been exported. There are
now about 750 bales on hand in San
Franolr 30 aud 300 elsewhere, leaving
about 1.0J5 ba!e for consumption at
home. There is every Indication that
hops will go to a higher figure- than
any are yet reached before the next
session,.
ON DISBARRING ATTORNEYS.
Last week we bad reference to an
afHadavlt submitted to the supreme
court by foui attorneys. . At the time
we had but little space at our dispo
sal no more than enough to say that
part of the affidavit which declared we
stated to either one of the men whose
names were attached that Sidney Dell
was the author of "Junius Brutus' "
letters was false. We had intend 3d to
write an, answer to the affidavit, but
Mr. Dell saves us the trouble by the
following letter addressed to the editor
of ibe Oregonian, which letter appear
ed In the Oregonian of Tuesday morn
ing :

court," in the Walker-Teal case.

The cnarge is amoiguous. 11 aoes not
specify whether the falsity is In the
facts as stated ty "Junius isruius" or
not. II they mean to allege that tne
facts In the case as stated by -'Junius
Brutus" are false in any material par
ticular then they are wilful falsifiers.
I have repeatedly in tne public press
dared these men to deny these facts. I
so ottered in he Oregojiau of Oct. 31st
in the following; Iaoauaite: "lr any one
can deny the facts or refute the logic,
1 agiee to resign tne omce ot attoj-ney
in the supreme court, to which I have
a vested right under the constituilou
aud the laws." No one dared take it
up; aud when on December (h some
one signing himself "Phiilippi," aud
whom I supposed to be W. H. Effin
Ster, slipped into the Stundard under
the mysterious caption, H. and V. vs.
T and G," as If shrinking from
public observation, and made a distoi
ted aud pecular defeuse, I at once re
plied politely, slating the facts aud
asking 'i'hi!Hpi' to admit or deny
them, and wiieu the facts are agreed
upon we could proceed to the discus
sion before the bar of public opinion.
The oniy eply I had was a broadside
of editorial abuse, and "rhlliipl" was
heard of no more. The affidavit men,
therefore, do not mean to allege, I sup
pose, that I have made a fidse state
ment 01 the racts. ir. then, the tacts
are correctly stated the conclusion of
law drawn by 'Juuius Brutus" Is ir
resistible. Such is the belief of the
independent bar and people ot Ore
gon. Kucn is the universal ci ill-
clam or the press of this coast, and
all the eastern newspapers which
have criticised it. The decision of the
court is utterly indefensible aud in
disregard of the plainest fundamental
prijciplesof law. If, then, the facts
are correct and the conclusion of law
sound it must be that these affidavit
men mean to charge that the impu
tation of motive to Judge Kelly of
actiug upon the partiality of friend
ship for a man who had done
mm a great lavor was iaise. mis,
however, is like special pleading on a
trope, or a bill of indictment against
a metaphor. If there is no Kw to sus
tain the decision it iaplaiu that some
motive must have actuated the judge.
Is, then, the Imputation of partiality
to a friend a "false" inference ? If it
is, then some motive beside mere frail
ty must be iuferred. Less generous ;
persons than myself assert graver rea
sons. I scorn to charge any criminal
motive unless I bad the proof. I am
prepared to show that the facts, ou
which my inference is based, ae true.
The only difference between meaud the
rest of independent bar is that I express
publicly, in behalf of public justice,
what they express privately. If, tht-n
I am to be silenced by the snpieme
court so should be all the independent
lawyers in the state, and nobody al
lowed to practice law except the servile
flatterers of the court aud the members
of the legal iug. Our Euglish fore
fathers weut into revolution and over
turned the "star chamber" courts, and
succeeded in establishing the fun
damental principle that "uo court
shall be secret, but justice shall be ad
ministered openly and without pur
chase.'1 This great piinciple has oeen
adopted in our constitution. But of
what avad is the piinciple, if none but
servile flatterers of the court are al
lowed to practice befoie it? How can
the people ever know the outrages
on justice if an honest attorney
tells them at the risk of hav
ing his only means of livelihood
cut off by these powerful public ser
vants? Is it not plain thai such a
couise makes the decisions or our
highest court a st aled book to the peo
ple aud the court a "star chamber'
whose judgments may be peddled out
to the hiahest bidder? An indenend.
ent and fearless bar is only real guar
anty of the people against thetyr.iuny
aud injustice of theeourlB; and if the
people fail to stand up to and support
the attorney who has the courage to
assert their rights they deserve lo be
robbed, und to hold their lives and
property bv Ihe frail and uncertain
lenuie of the whims, caprices, or even
venality of their hifchest courts. If
the court decide acco, ding to law,
they can bear criticism, and the oaly
effect of an unfounded attack upon
them la to relegate the attorney who
makes it to the scoru and contempt of
all good citizens. If the attack is just
aud unanswerable before 'he bar of
public opinion, then the effort to den
troy the fearless attorney who makes
it will be a coufessien by the court of
wroug doing, aud will only provoke
the indignation of a free people. In
this connection I give the following
extract from the views of a distin
guished jurist aud statesman announ
ced In the supreme court of the United
Stales nearly fifty years ago. He says
"In no civilized country with which
I am acquainted has the power been
assumed of striking an attorney from
the rolls of the court for publis ling
even a libel. It is the dis
tinuishing glory of eur institutions
that a public functionary can claim
no immunity, no exemption from
public scrutiny and public censure,
that does not belong equally to a pri
vai citueu." Another equally dis
tinguished said: "By the summary
process adopted by the jndje, the at
torney is stripped of every right guar
anteed to freemen. Hii prosecutor is
the judge himself; the offeuse imputed
lo him, cloak the matter as we can, Is
one against the judge himself; and he
the aggrieved party, erects himself
into a tribunal, to try before himself
and punish by his sole authority, this
wrong against himself. " "lam
fully warranted in maintaining that
no adjudged case in modern" limes can
he produced showing the exercise of
the power of au Engliof pun-sh couit
ishiug, as for contempt, libelous pub
lications oncourlsor parties to suits,
in reference to causes finally adjudi
cated and decided.' Another who'
obtained even a wider fame not on'y
in this country but abroad, said: It Is
important then to know whether
henceforward au attorney must hum
ble himself and before the tycopbant
of a judge, whom he may despise,
under the penalty of being deprived of
the r gbt to practice his profession be
fore him. If a judge be weak, or if he
be wicked, his judicial conduct Is as
fair a subject of discussion among law
yers as anions any other class of citi
zens; and for exercising this right
they Incur no punishment which can
not be inflicted on any other person.
If this proposition be not tre, they
become the mere creatures of the
court. Instead of being the firm and
fear less assert era of their clients'
rights, they must cringe and assent to
any and every intimidation of the
judge at the risk of their ruin. The
public have almost as deep an interest
in the independence of the liar as of
the bench. If I write and pub
lish an article which a jude may
consider as a libel upon himself, Is it
not enough that he may appeal, like
other citizens, to the laws of his
country for redress, and have me
fined and imprisoned for the offense ?
Shall be be permitted to take the law
in bis own hands, aud add to this
punishment a forfeiture of my means
of subsistence by taking away my pro

prisonment, would be mercy, when

Henry Kelso was arrested at a ball
at Independence last Christmas eve
by the marshall of that place, on an
order by Sheriff Mathews of Washing
ton county, on a charge of seduction
of a young woman rrder promise of

bond. Young Kelso, when first
