the absence of tyye. Blank spaces
will nearly always improve an ad

window advertising is to be seen at

It consists of a miniature battle

It is very unique and shows great
skill in the designer. Mr. Simp

Although a failure of crops would
mean a failure along other lines
also, nevertheless the bor d of sym
pathy existing between all men is
there anywav, croos or no crops
The wheat crop is turning out bet
ter than was expected, there will
be enough hay if the winter is mild,
the fall vegetables and fruit, ex
cepting prunes, will be sufficient for
our needs and it all goes to show
that Oregon is a land of milk and

Huard vs Kimball.
The case of Al Huard and E.
M. Kimball that has been in the
court-for some time was up for
adjadicatioii in court, yesterday,
and dismissed as being outside
the court's jurisdiction. Both
parties live over in Alsea and Mr.
Kimball finds it necessary to
cross Huard' s land to reach the
country road. An altercation
occurred about three months ago
in which Huard shot Kimball
for trespassing, nearly resulting
fatally. Kimball petitioned the
county court to lav out a road
through" Huard' s land and this
petition was up for decision ye;
terday and was not .granted for
this reason:
Kimball has another residence
near the county road and he was
living there at the time of regis
tration which established that as
his residence in the legal sense.
The law requires that a petitioner
must haye actual residence on
the land. Mr. Kimball will be
required to take up his residence
on the land in question which
lies back from the county road
and adioining Huard's 'residence
before he can have the petition
granted. This Kimball fully in
tends to do. Huard is threaten
insr violence even it the road is
granted. Mr. Kimball is a well
educated, highly respected citl
zen, and will- do what is right to
have the matter adjusted.
