AGAINST THE MERGER.
United States Attorney Gtneral
Knox will institute proceedings
against the merger of The Great
Northern and the Northern Pa
cific railroads into the Northern
Securities fcotnpany. Although
the Securities company is char
tered by the statefof New Jersey
the attorney general does not
fear trenching on state rights.
After a careful examination of
the subject he is satisfied he has
all the necessary authority in the
Shtrman trust law. The chief
law officers in several of the states
coincide with General Knox in
this view.
The argument that because
such corporations or trusts are in
corporated by a state in the ex
ercise of its sovereignty they can
not be controlled by federal
authority never was a valid one,
for the moment they engage in
interstate commerce they pass
within the authority of the na
tional government So long have
they escaped just control by ap
peals to the bogy of state rights;
so firmly have they entrenched
themselves in place and power,
that multitudes of men have
come to regard their control im
possible unless the federal consti
tution were first amended with
that purpose in view.
We have always held that con
gress has ample power under the
constitution as it is, and if ade
quate laws did not exist congress
should supply them. We aie al
together confident that with the
republican party in control of
the government the great trans
continental railways will be
brought under just public con
trol. In many of the states the
control of the great manufactur
ing and mining corporations is
receiving intelligent and caieful
consideration. It is everywhere
recognized that these combina
tions are made necessary by the
modern conditions which govern
industrial development. Only
bv such means can the cost of
production be minimized and
high wage scale maintained.
Working to these ends such
combinations can do no ill. But
so great is their , power and influ
ence that it is necessary for the
State to maintain a vigilent su
pervision over their conduct
This is what the several states
will do, and a number are al
ready doing.
- Like the mill of the gods the
eovernment moves slowlv. It
has not been moved by the evil
foreboding of the timid, nor in
flaenced bv the inouthinffs of
demagogues; neither will it turn
aside from its purpose of inaugu
rating and maintaining a just
control over these great corpora
tions. With the federal and
state governments coming into
greater harmony on this subject,
fine perplexing and disturbing
industrial and social problem will
soon be carried to a solution so
practical and right that no dem
agogue can even hope to persuade
the ghost of state rights to gab
ber dissent
TBE PRESIDENTS DECISION.
The dicision of the president
on the appeal of Admiral Schley
should be no surprise to those
who carefully followed the pro
ceedings of the naval court of in
quiry and who are familiar with
the naval operations culmina
ting in the destruction of the
Spauish fleet off Santiago. After
a very careful and dispassionate
review of all the facts and of the
testimony given before the court
the president declines to disturb
its finding and directs that the
case be treated as closed.
The actual battle was a fight
by the captains. Schley is not
entitled to any more credit than
the captain of his flag ship, the
Brooklyn nor to so much for
daring courage and dash as the
captain of the little Gloucester.
In the fight Evans, Philip and
Clark earned even more glory
than Schley. They promptly
closed in on the enemy and
fought him to a finish. Old sol
diers can recall engagements of
this character. The first two
day's fight in the wilderness cam
paign of the Army of the Poto
mac was largely a fiht of regi
ments and companies directed by
their own immediate command
ers, yet oecause 01 tnis no one
ever thotght of withohlding from
Head and Grant their proper
share of credit as commanders of
the army and authors of the
campaign, f
When 'there is glory enough
to go all around" as Lincoln put
it it is pitiable to sec good, brave
men wrought over it as school
boys over a game of marbles.
For the honor of the navy and
the men behind the " emus it is to
be hoped that the action of the
president closes the case and
that s: much of history shall
never repeat itself.
