OUR TREATY WITH SPAIN.
The Hillsboro Independent
says "the Gazette does not get
the right idea of the Spanish
treaty. The treaty was (is) not
commercial, and when Spanish
ships were given the same rights
as American it was part of the
purchase price by which the
Philippines passed to us."
Let us recall facts. We had
war with Spain. War abrogates
all treaties between the belliger
ents. At the close of our war
with Spain we had no treaty of
any sort with her. The treaty
tinder consideration was then en
tered into. Its provisions restore
amity and re-establish commer
cial relations between Spain and
ourselves. We have no other
treaty with her, hence this treaty
or some of its provisions are, and
and of necessity must be, com
mercial. This disposes of the
assertion that the treaty is not
commercial.
But the treaty also cedes to the
United States certain possessions
of Spain. The provisions gov
erning this cession are found in
the second and third articles of
the treaty. The third article
cedes the Philippine islands, de
termines their boundaries and
closes with the provision that
"the United States will pay to
Spain the sum of twenty million
dollars within three months after
the exchange of the ratifications
of the present treaty." These
two articles make cession of all
the territory we acquire from
Spain and name the equivalent
we give to her. The remaining
articles of the treaty provide for
the commercial relations that
shall exist between the two
nations, for the manner in which
the actual transfer shall be made,
and what the statvis of the late
subjects of Spain shall be. These
constitute the treaty of amity and
commerce we have with Spain
Had the treaty ' ended with the
third article and the usual pro
vision for ratification it would
have conveyed the Philippines
to us arid granted to Spain all
the equivalent we intended. This
is clearly what the plenipotenti
aries who' framed the treaty in-
tended and understood. It must
be the conclusion of every unbi
ased man who is familiar with
the rules of legal interpretation,
and closely, examines the treaty.
The fourth article is no more a
part of the "quid pro quo" than
are the fourthteenth, fifteenth
and sixteenth articles. This is
the article 'which "admits Span
ish ships and merchandise to the
ports of the Philippine islands on
the same terms as the ships and
merchandise of the United States. '
If we treat ourselves to free
trade with the Philippines we
must accord it to Spain, who
thereby becomes the most favored
nation. England, Germany,
France and gother nations may
then rightfully point to our treats
stipulation with them which
gives them "all the rights and
privileges enjoyed by , the most
favored nation." This would
open the Philippines to free trade
with the world. The enemies of
protection know this, and there
fore seek to bring it about. This
also is the main reason why con
gress insists upon Dingley rates.
It Sounds Like Business.
Everything in the way of busi
ness looks exceedingly bright
for the future. During the com
ing season there will be an un
usual amount of building done,
both in the City of Corvallis and
in the county. Real estate is
changing hands every day. Peo
ple of means are taking up their
residence with us and are invest
ing their money in various ways
that will tend to up-build our
community. New enterprises
are talked of and some have al
ready been inaugurated. What
we need as badlv as anything is
a variety of factories. A factory,
with its hum of machinery aud
whistle sounding in a town gives
it an air of business. It seems
that some of the places in Cor
vallis that are fitted with steam
whistles are a little too modest
about blowing them. Let us
hear how they soand it will
not cost much aud our people
will in time become accustomed
to hearing them.
Has Again Escaped.
El wood A. Chenoweth, a pa
tient working in the laundry at
the asylun, walked out of that
department at 4 p. m., January
xst, and escaped,
and though a
diligent search was at'onee com
menced, no . trace of him was
found. The man was- sent up
from Union county last fall, and
while on Jhis way here escaped
from the sheriff by jumping off
an O. R. & N. train, while it
was running 40 miles an hour.
He was later found, and brought
to the Asylum on Decemoer 12, ;
iyor. He is 35 years old. ;
The above dispatch recalls the j
fact that Chenoweth was taken I
to Salem from Corvallis ty Sher- j
iff D. Y. K. Deering, of Union
county, and was accompanied b
Sheriff Burnett. Chenoweth has
become notorious for the many
times that he has eluded officers
who had him in charge. ' Along
about the end of the first week
in December the patient walked
into the sheriff's office in this
city and calmly announced to S
L. Henderson, who was acting
as deputy for Sheriff Burnett at
.the time that he desired to be
taken to Salem. "Sam:," was
so astounded that he thought
some joke was being perpetrated
for a time, but finally took
charge of the man.
Chenoweth is sane enough on
nearly everything but religion
On this point his mind is un
hinged. He stated on several
occasions that he did not have to
go to Salem unless he wanted to,
but that at that ti ; e he had con
cluded to ffo down. He stated
also that whenever he so desired
that he could easily escape. It
seems that he has kept his word.
He is well knortn by James D.
Zurcher. an O A C student trom
Union county.
How it came that he wandered
to this city after escaping from
the officers on the O R & N
tiain is still a mystery.

heaven and Olympus. Then she fouud
the far-seeing son of Krono sitting
apart from the rest on the highest peak

seated herself right before him, and seiz
ad him by the knees with her left hand
Then seizing him under the chin with
her risrht hand. she. in prayer, spoke to
Zeus, the son Kronoe king:

dishonored him ; for he seized and now

tility to Hera when she excites me with
reproachful words for granting thy re

The Leona Snagged.
The stage ot the river is get
ting so low that navigation is be
ing carried on with caution, and
even this does not prevent acci
dents. Tuesday evening the
steamer Leona, which has been
pfying between Salem and up
river points for the past month,
ran info a snag about seven miles
above. Corvallis, and Captain
Graham ran her onto a bar,
where she sank in three feet of
water,
She was on her way
down from Peoria with 1,000
sacks ot wheat. .Neither the
steamer nor her cargo was mater
ially damaged. The steamer

Wednesday morning relieved

few hours the latter vessel "was
afloat and" the rent patched,
when she proceeded to this city.
