A MATERIAL REASON.
Considerable has Ireen said in re
lation to the efforts tc get the board
of engineers and congress to con
tinue the work of improving the
ship canal at Yaquina bay. The
blame has been laid first by one
and then another to various causes.
Those who could not rise above the
habit of at all times of belittleLig
a political opponent have en
deavored to attach the whole blame
to lack of effort in congress on the
part of Representative Thomas
. Tongue, while at the same time
they say nothing .against our other
representative and members of
the senate for the falling off of the
support which the improvement of
the harbor once had. This sug
gests that the thrusts at Mr.
Tongue are simply for political
reasons. It iswonderful that some
of them do not attribute the bad
luck to Yaquina bay to the expan
sion policy and charge it up -gainst
President McKinley. This phase
of the subject may develop when
all other pretenses are exhausted
against our president.
The failure to secure support to
push the improvement of Yaquina
harbor is due no doubt to several
causes which can be mentioned
and possibly others which have
not been noticed. Prior to the
time wheu the improvement of
Yaquina harbor ' bsgan, it was
claimed by newspapers andothers
wnose enorts were strong to con
demn it, that it was a mere noth
ing and could not be developed to
admit of seagoing trade, but the
efforts of the Hogs, while they
- were in management of the Oregon
Pacific railroad to Yaquina bay
disproved that theory and estab
lished the fact that quite a large
trade could be carried on through
that channel. It served so largely
s a regulator of freights, that for
several years wheat, oats and other
articles of produce were about the
same price at Corvallis and other
neighboring towns as the Portland
market afforded. As a regulator
to keep down high freights the Ya
quina bay saved to Western Oregcn
people thousands of dollars every
year. On the other hand mer
chandise at low rates of freight was
shipped through Yaquina harbor
for all points in Southern Oregon
and the Willamette valley and con
siderable freight which came
through that way was delivered to
t shippers in Portland, The very
large shipping business done dur
ing those times through Yaquina
bay demonstrated that those who
condemned it as a practical harbor
were mistaken. This trade through
Yaquina harbor would no doubt
have continued and increased, but
for the fact that the Hogg manage
ment of the Oregon Pacific railroad
was extravagant and unusually
expensive. It became so involved
that its affairs were placed in the
hands of a receiver. Under the re
ceiver's management the Yaquina
trade could not jbe built up, but
necessarily declined, for the reason
that after the Hogg management
ceased adequate facilities for ocean
shipment was not provided, and
the trade was in that manner
drawn away to other channels of
commerce. After the receivership
terminated the railroad which sup
plied the traffic to and from Ya
quina harbor felLinto hands which
preferred te allow the trade to run
down and permit the system to be
managed so as not to take any
trade away from the Southern Pa
cific, but to protect and built up
the Southern Pacific system of
traffic rather than to build up its
own. To build up the Columbia
river traffic by trying to discourage
and tear down every other source
of ingress and egress, has been the
constant effort of a very large and
influential contingent. The Hogg
management was able to overcome
that influence, but the present
managers prefer to float along with
that tendency " rather than oppose
it. The report of the United States
engineers adversely to the improve
ment of Yaquina harbor is no
new condition. A very large con
tingent of those distinguished gen
tlemen of much red tape, large
salaries and little results have fre
quat.tly reported adversely during
the progress of the work, but the
Hogg management was powerful
and influential enough to overcome
ll such opposition, and get con
gress to proceed with the work.

consider the Hogg management to
have been a good one, but on the
contrary, we think its manage-

merit was not on the whole, good.
It was too extravagant and expen
sive hut it did not lack activity and
push to accomplish the work. Had
it not been for their unusually
large expenditures in directions
which might have been saved it
seems to many that their efforts to
build the road through to an East
ern connection would have been suc
cessful. Prior to the Oregon Pacific
railroad going into the hands of
a receiver, Willamette valley news
papers were copstantly ; united in
urging the improvement of the har
bor, giving the vast benefits that
the results thereof were to the peo
ple. " Since the advent of the re
ceivership scarcely any of th news
papers have said anything about
it. With proper and necessary ,
efforts the improvement of Ya
quina haibor, connected with the
building of the railroad to an East
ern connection would save , the
people of Oregon a great deal, be
come a material factor in building
up the state, and the railroad
system connected therewith finally
become a paying investment.
A PENNOYER PECULIARITY.
The American law review recent
ly published a very long-and labor
ed, article by Ex.-Gov. Pennoyer of
Oregon in which, in his character
istic way, he attempts to give rea
sons, which he assumes areclear to
hia peculiar condition of mind, why
the Supreme Court of the United
States should be deprived of the
power to construe the various pro
visions of the constitution of the
United States and thereunder de
clare whether or not laws passed
by congress or by the several legis
latures of the different states are in
harmony with the constitution or
contrary to its provisions. If con
gress ahould pass a law which was
entirely contrary or opposed to some
of thefundimental provisions of the
Federal Constitution, according to
Mr. Pennoyer'e argument,thelaw so '
passed should stand and be followed ,
and obeyed and the provisions Jof I
the constitution should be set aside
and held for naught, because accor-
ding to his reasoning there would
be no power to interpret whether
such a law was opposed or conform
ed to the provisions of the constitu
tion, because he would deprive the
Supreme' Court of the United States
of its authority and power lo so
interpret the constitution and the
laws. Mr. Pennoyer would no doubt
leave it so that each and every man
would be a court unto himself, to
interpret the constitution and laws,
of the land with no right of appeal
therefrom. Possibly he would car
ry his idea'a step further and have
the conditions of law, order and the
courts as they were in this country
prior to the time when theMayflower
landel her precious load of pilgrims
on the' shores of this country. The
Ex. Governor entertains such a
strong animosity to the court and
constituted authority of the country
that a great many persons pause
and wonder what it is that he
wishes to do. In this article men
tioned he makes use of the following
language "The law should be su
preme, and the law breaker, wheth
er a federal judge or an openly
avowed anarchist, should be re
strained." He should have added
"and when I get the offices of judge
and courts abolished or deprived of
all power, that the governor can
cause all of the Chinese to leaye the
state, pardon all of the criminals
out of the penitentiary; so conduct
