CORRECTION Of LAW MAT
TERS. The administration of the law,
in various ways, is not acceptable
to the general public, and many
methods of improvement have
been suggested. Among other
criticisms in that direction cornea
in that of . A. Clark in the Over
land Monthly, lie asks what is
the remedy for the universally
acknowledged defects in ou
present system of jurinpiudence?
It is to restore to our courts, with
all their offices, the position oi
perfectly impartial arbiters be
tween parties litigant. Let eveiy
department of public arbit-ation
be as entirely free from influence
of fees, or pay, or promise of pay,
from either party, as is the presiu"
iog judge. Restore these arena
of gladiatorial le?al combat to
their true functions as court of
justice. When disagreeing citizens
appeal to public arbitrament, let
that appeal be complete and abso
lute. Do not permit them to come
into court for legal adjudication
with a bired intellectual slogger to
delay and obstruct in functions.
If litigants or their agents must
bandy words, and wrangle and
qaarrel, let them do it out of com t,
where they will not tale vp the
time of diainteiesieJ wi'nesses,
jurors, and the court, whose time
belongs to the state. "What!"
says some conservative soul, "Not
give a man the advantage of legal
counsel?" Yes; let him employ
and pay for as maoh counsel and
- advice as he pleases f'om coun
selors at law, but let this be done
outside of court. Says anollur:
"Shall we not have any aUorreys
to manage cases in court, and as
sist the court and jury to arrive at
the facts?" Certa;nly; but let
these attorneys be re?Uy, as they
are now by fiction, office's of the
court, sworn as such, paid aa
such, sad subject to the same
penalties for receiving fees or
bribes as are the court, ju-y and
sheriff. They should be assisted
by the court to represent lii;gnt9,
to arrive at the facts, examine the
law, and in every way possible as
sist the court in administering
justice. They would have no more
motive to distort fact?, mystify the
jury, or delay the trial of causes,
than the couit itself. Their in
terest would be to "to have the
right come uppermost, and have
substantial justice done." There
should be a sufficient Lumber ,l
these court attorneys selected to
conduct all investigation with dis
patch. They should be paid liberal
salaries, and should be chosen cn
account of their legal knowledge
and honesty. At Iirt siht this
plan might aeem to blot out the
profession of law, but it would not
do so. Oatside of courts there
would bv abundant scope for the
profession, and many would be
needed to 11 the positions of court
attorneys. Those in private prac
tice wor'd be consulting attorneys,
and it would be for their interest
always to give honest legal opin
ions and aarice. it woiuu never
Le to their interest to lure men in
to litigation. Now it is notorious
that men are every day advised
yea, urged into expensive litiga
tion by attorneys, when they know
the ease is exceedingly doubtful.
The attorney, however, thinks he
may be able to so manage the
election of a jury, orsoniywtify
them by his sophistry or his elo
quence, aa to make "the worse ap
pear the better reason." and so win
the case for his client. But in a
true system, where he was simply
paid for his he nest opinion and
honest advice, there would be no
temptation of this kind, because
be could not follow the ca6e into
court. The result of this would be
that the volume of litigation would
be wonderfully decreased, and the
number of courts and judges would
be greatly diminished. Litigants
would not be obliged to wait a life
time for the adjustment of their
cases. An immense amount of
rubbish in the shade of legal
technicalities would be cleared
away and the rules of practice
would be veay much simplified. A
new jurisdiction would be built
op, founded always on clear rules
of reason and common sense, and
not on the obsolete precedents of
past ares. Law would become a
science, and cease to be a hotch
potch of rules and practices fre
quently opposed to reason and
subversive of justice. Lawyers
would be men of learning, men of
science, and men of progress,
studying the present and future,
instead of constantly looking over
their thoulders and studying the
past. The genu1 shyster would
disappear from society, because his
occupation would be gone. the
poor man or the poor woman, with
an honest demand, would be the
perfect equal in court with the
millionaire.
