TIIK PERSISTENCE OF WRONG
The extent to which the viscious
achcmea of men are carried are
really remarkable, and one cannot
bat think if all of this energy was
directed in the right channel,
what a world of good it might ac
complish. An example of this ia found in
the recent decision of the Buprenie
court of Louisiana, compelling the
secretary of state to officially pro
mulgate the constitutional amend
ment adopted by the last Louisi
ana legislature proriding for
submitting a continuation of the
charter of the lottery to the people
despite the veto of the governor
which the Richmond Times says
settles one very important and
interesting fact, and that is that
constitutional amen jments adopt
ed by the requisite two-thirds ma
jority of both houses of a state
legislature occupy a radically dif
ferent position from ordinary bills
The circumstances of this case are
well known. The charter of the
lottery was about to expire, and
the company determined to leave
no expedient untried to secure its
renewal for twenty-five years. To
effect this they offered to pay the
State of Louisiana $1,000,000 a
year for the term mentioned, and
this, when the impoverished con
dition of the state treasury was
considered, proved too great a
temptation for the legislature to
resist. Knowing, however, the
bitter animosity of Governor
Nicholls to the measure, ami that
he would be certain to veto any
ordinary bill which might bt
passed, the company induced the
legislature to adopt an amendment
to the state constitution providing
for renewal, such amendment, of
course, to be submitted to the
people foriatitication. After some
what of a prolonged struggle, the
amendment was adopted by exact
ly the necessary two-thirds major
ity in both houses, and it then
went to the governor, who vetoed
it and returned it to the legisla
ture. In the meantime, one of
the senators who had voted for it
became seriously and, as it proved,
fatally ill, and although efforts
were made to take him on his
couch to the senate chamber, so
that, though dying, his vote might
be recorded in order that the
amendment might be passed over
the veto, he was too weak to be
moved, lie finality died without
his vote being cast, and as it
needed that one vote to obtain the
desired two-thirds majority for the
' measure in the senate, the secre
tary of state held that amendment
was dead, and refused to have it
officially recorded and promulga
ted. The lottery company were
then compelled to resort to an
other expedient, and determined
to appeal to the supreme court for
a mandamus to cjmpel the secre
tary to give official recognition to
the amendment, on the ground
that the measure, being a constitu
tional amendment legally adopted
by the legislature, was not subject
Ut the governor's right of veto, anil
that toe only veto power laid with
the people. The point was argued
carefully at length, and finally the
court decided in favor of the lot
tery company. Whether the peo
ple will ratify the amendment or
not, and so renew the charter, is a
matter in which the wholecountiy
is more or less interested, for the
lottery abomination has for years
been the great demoralizer of the
people of every state of the Union.
It is to be feared they will, for
apart from the tempting offer of
tti e company tu reduce their taxes
t ttie extent of $1,000,000 a year
for a quarter of a century, money
for the purchase of voters will le
speat like water, and, unfortunate
ly, there are a very large class of
voters in Louisiana always ready
to cast their ballots in accordance
with the wishes of the higbsst bid
der. The main point of the iiiesent
interest, however, i9 that men-
tioned at the beginning of thin
article, which is that according to
a majority decision of the I.ouiti
ana supreme court, amendments
to state constitutions legally
adopted are not subjects to execu
tive veto. Such is the law of
Louisiana, and will be regarded as
authority throughout the Union
unless set aside by the supreme
court of some other stote, in w hich
vent, so far as that state is
concerned, it will he inoperative.

least. Hardly has the curiosity
allowed to cool down over the

their lives by trying to run the
guards in Italy while larking on
full potations of intoxicants. Some
of these days even the scions
themselves will conclude they are
hut common clay and subject to
tue same natural laws as other
human beings.

will stand upon th silver coinage
question. As he seems inclined

interested ones will probably have
