PA TESTS A SO COPY RIO 1TS.
The patent right business, per
haps more than any other in the
country, has been anil still is tl e
active 'factor in our civilization.
It has set the wheels of progress
in motion anil keeps them spin
ning with siu'h an aeeeleratetl
speed that there is no stop i.or stay
to them. The I'.o.stoii !ilile saye
that the country has ju- t lon.p'cti i;
its tirst century of experience with
patent law. The lirst statute en
acted concerning paU-nls was in
IT'.H). Mr. Madison is stipjiosed to
have been the author of the patent
provision in the constitution, In
having intriKliii-eil the clause in
1737. It is dirlieiilt toesliuiate the
influence of patents upon the
wealth anil progress of the country.
1 hying tlie year alter the lirst
statute was enacted lint three
patents were granted. Now thou
sands are granted yearly, and over
-TiO.tXK) in all have been granted
t tlie present time. Count ini: t lie
aggregate wealth of the country at
$ :i,(H)0,000,000, it is estimated that
two-thirds of it id due to inven
tions upon which patents have
been secured. There is a close
analogy between a patent and a
copyrigth, the latter being practi
cally a patent secured on some
kind of metal invention put in type
or found in a map, drawing, or
picture of some kind. The snb
ject of patents and copyrights has
an unceasing interest for people
who think, Mince it involves the
very interesting iiestion of the
- proper limits of property in ideas.
There seems to lie little lonlt,
however, that ti e notion of "per
petual property in an idea' is not
tenable. The fact that both
patents and copyrights are made
the subjects of statute law is in it
self pretty conclnsiveevidence that
they are proper subjects of statu
tory limitation. It is said that if
Shakespeare had taken out a copy
right on his plays, and it had re
mained as the perpetual property
of his legal heirs and as-signs, a
fortune would have been amassed
eiual in value lo half -of Ureal
Britain. Such thinyrs shou the
absurdity of the claim tiiat ideas
and combinations of words should
be property like other property.
Tiik labor ipiestiou tonus a
more puzlirig and difficult matter
to diHK)e of, than any of I lie great
iuestions that are now agitating
t lie country. TUe views upon it
are almost as multifarious as the
iudi iduals that entertain and ex
press them. Mr. Malloi k in the
April Forum gives the problem
some careful thought in the course
of which he says: What history
is teaching us is that the lahoivis
may be organized in two ways:
Firstly as a producing body;
secondly as a resisting or self pro
tecting lxuly. In the laiter
capacity thev mav be able In irov-
ern themselves, but in the lirst !
they n.n 1 1 e always hego.e rued by
others ; the conclusion is that in the
very natuie of things it is impossi
ble lor either party to gain a com
plete victory. It is obvious that
the capitalist cannot exist without
the laliorer. A deeper and more
dispassionate study of human
nature will in time convince even
our most ardent social reformers
that the laliorer w ill never progress
except with the progress of the
capitalist. The uiiies of things
and the forms of things may
change ; but the essential fads of
the case, being fads of human
nature will always remain the
same, till human nature is meta
morphosed. The ipiei j is being propounded
by siiiue of the curious ones, as to
w hat' would be the status of Koliert
Kay Hamilton if he should yet j
turn up, and the body found in the
Yellowstone park, should prove
after all not to have been that of
the person know n as Hubert Hay
Hamilton, w ho made such a sensa
tion by marrying a lady whose
morals were not above reproach.
The surrogate court of New York
has pronounced the gentlemen
legally dead, so if he comes back
he has no rights in thia land of
the living, but must assume the
role of a dead man. Would he be
a ghost ?
THE I TA L I A AT TROUT, I. E.
The warlike aspect of affairs, in
the relations of this country with
Italy, in all probability will be in
appearance only. The action of
the Italian Minister at Washing
ton, it is said is not necessarily
warlike, and the result may
demonstrate that it was brought
aliout by a mistaken conception of
ihe somew hat hasty and impolitic
letter of the Uevernorof l-ouisiana.
The formidable war vessels of
the Italian government play quite
a figure in rousing a nightmare in
the minds of the tiuiifl ones, and
giving food for the renewal of the
demands, in certain quarters, for
Ihe building of war vessels and
coast defenses.
The diplomatic negotiations may
be somewhat complicated and
elongated, by the action taken, but
a full settlement will undoubtedly
l3 reached through its agency.
Neither government wants any
war, and would have nothing to
gain by war, and there will be
none. We are extremely fortunate
in having as t rue a firm and as cool
a hand at the helm of the state
department, as we possess in
Secretary Blaine. The war cloud
will disperse without damage to
any one.
