One of the difficult and formid
able problems tht has engaged
the attention of the human family,
ever oinre the barnyard fowl ha?

domest'i-ity, if to decide which
hen can claim maternity for the
. chicken, the hen that lays the egt
or the one that hatches. '
Happily for the peace and weHthij, li;caljtv. remarked that he
fare of future generations, the
vexed question has at last been
settled, according to the Tribune.
It was decided by Justice
McMahon, of Parkville, a small
but interesting suburb of the City
of Churches. It is the first case of
the kind known to have been
brought into court, and by reason
of its unique importance the trial
has occupied much time of the pre
siding justice. The facts nre that
a farmer McCaughn and Fanner
Gormley arejiext door neighbors,
ami their henuerus adjoin each
other. Farmer McCaughn ons
choice birds, but the fowls bel ng
ing to his neighbor are of the
ordinary farmyard standard. It
was.t-eified to that one of Farmer
McCaughn 'a hens scrambled ovei
the fence and indiscreetly, if not
wickedly and feloniously ; did lay
two eggs, at d; vers time, on Farmer
Gonnley's premises, The triumph
ant note which heralded this
maternal achievement did not sug
gest . to Farmer Gormley the
propriety of picking up the eggs
and delivering them ii.to the
possession of the owner of the hen.
On the contrary, he promply put
them under a setting hen owned
by himself, and in due course of
time they were hatched.
So soon as their feat hers and little
red combs began to grow Farmer
McCaughn observed that these
dubious chickens were full-blooded
game birds, like those of his own
hennery, and he made a demand
for them. Fanner G nuley denied
the claim of ownership with
emphasis and disdain. Then
Farmer Caughn summoned his
chicken-raising neighbor before the
court for trial, and issue was joined.
The question was not between ben
and hen, but between farmer and
farmer; or, rather, it was a ques
tion as to whose hen was the
mother of the chickens. Now
ordinary common-sense would sug
gest that as the hatching of
chickens is a mere mechanical
process, ch;efly dependent upon
caloric, as science has demon
strated most thoroughly, it is not
characteristic, or necessarily even
suggestive, of motherhood. The
setting-hen is unquestionably an
efficient incubator ,and so too would
be a rooster, if you could get him
to set long enough ; but who would
presume to say that a rooster could
become a mother, even ii he should
hati-h a dozen broods? Justice
McMahon has decided that Fanner
Gormley mut surrender the two
chickens to Farmer McCaughn, or
pay to him the full amount of their
value. But is not Farmer Uormley
entitled to pay for the ltbor and
services of his hen in hatching
the eggs? The decision of the
justice is righteous as to the main
point at issue, but he seems to
have overlooked th fundamental
propriety of a counter claim. We
advise Farmer Gormley to ap?al.
While upon the question of the
mortgage tax law, it .night be well
; enough to view one of the argu
ments now being repeatedly and
persistently urged by the press f
the state. It is that the law wa
enacted to make money cheaper
that is the rate of interest lower
and easier to procure. Any one
advancing such an argument
imply does not know what he ia",e'!

it. The simple idea of the mort
gage tax law was to make the inoit
g ges taxable in the counties v. here
given and thus give a valuation
for taxation in lieu of the lands
that the mortgages exempted from
taxation, and with the exception
of catching some foreign capital
brought here to loan on real estate
that is all the (feet that the mort
gage tax law had. Credits were
subject to taxation before its pas
sage, but prior to its passage, for
instance, Portland capital could
come into Linn county and be
loaned u on real estate and the as
sessment of he credit was taken
in Portland and the land effected
was removed from the asussuvnt
list in Linn county , thus inert aeing
the v.:l'iation of Portland and de
creasing the valuation hce, and
of course making the levy less
there al higher here. That is
wh:t the -iiortgage tax law was
made to correct. Those who are
so vociferously clamoring for its
repeal better htudy it up a little
and know what ttiey are talking
about.

very hard to get there and interest
high. What, was asked, is interest
high in Washington? Why the
Oregonian and almost the entire
preesof this state are constantlysay
ing that interest is lower there than
here. He asked about ihe rate
of interest here, aud, said when
told what it was, that the rate wan
higher there than here. So much
tor the trutti of one of the most
harped upon arguments for the
repeal of the mortgage tax aud
usury laws.
These is one legitimate argu
ment in fnvor of the repeal of the
mortgage tax law, but it is one of
poHcy j lone, and one too that the
clamorerg have as vet failed to put
forward. It is the simple fact that
the hitter fighting "gainst the law
in some quarters has resulted in
the non payment of nssessed taxes,
and that counties have to pay the
state their proportion of tlw-t un
paid taxes without getting any
immediate returns.'
