A MIST ME-
I refer to the article I. B. Fisher i
published in the Hkhai.d entitled
''The Evangelical Kupture."
His quotation from "1'he Evan
gelical Messenuer." issued June
24th savs "Dubs, in his version of
the aff.dr, is careful not to tell nis
rodent about the bond that is re
quired of the plaintiffs which is an
essential prt of the decision.
That this is a mistake, anu as
well uniust to Dubs, will be seen
from the following facts in in the
case: Lut)8 in nis paper issue"
June 12th closed the article of
Imlce Smith's decision with tnis
paragraph, viz: "The opinion of
the court is that the injunction
shall remain, but it ought to heat-
iended with a bond."
Aiiain, on the same page ot the
same issue, Dubs says : "There
quired bail of $20u) is provided.
Ten brethren in Napeivuie nitve
furnished the same. Usually this
bail is required when the prelimi
nary injunction is granted. This
not being done in this instance,
therefore is ordered by Judge
Smut . This is not ot much mi
p rtance. It is simply complying
with the law."
Now reader is it not true after
Duos paid all this "about the
bond" that Judue Smith urdered
hen he decided the Naperville
church case in favor of the anti
Esherites, that Dubs did tell his
readers thereof ? Yes, he did so,
and that twelve days b fore said
citation published in "Evangelical
Messenger."
Whether said mistake, however,
is attributable to the realization of
the boast of some that they "do
not read the other side." I will not
say.
The mistake and denial however
are there, and, again I say un
just to Dubs in the light of the
above facts.
It is also interesting how thei
''sher and Bowmanites trv to
weaken the force of what Judge j
-mith said on rendering his de
cision. He : : ome length re
viewed' the I'un-os and premises
of his final conclusion.
Therein he says: "1st, The
record introduced here shows
clearly that Bishop Eeher had be
fore then been convicted and de-po-ed,
or suspended, from bis
office as bishop as w ell as preacher,
and that he li id n right whatever
in that conference for any put pose
except as a looker-on."
Agiin he furthir said: "The
claim there made by Bishop
Kher to preside over the confer
ence was without authority and
wrongful, and the conference did
right iu excluding him and elect
ing an elder to preside in his
stead. Conceding Bishop Eeher
to be still the b shop he could not
act anywhere with a minority of
the delegates and without a
quoi uin. All acts done by such a
body are cleany illegal and void,
und an appointment from that
body of a preacher to the Naper
ville church was beyond all ques
tion illegal and void, and when
the p'eacher was appointed by
tha !ody and sought entrance to
the hu:ch, he could only be a
trebi'asser."
These last quotations I have
made from the Ottawa Journal of
June 5th, which copy was fur
nished them in JimVe Mnith's
own handwriting, as I undeis'aiid
Rev. P. Zahn, w ho i-ays, "1 have
seen it myself and he told me per
sonally he w rote it."
July 19, 18'JO.
J. BOWKRSOX.
P. S. As I understand it Juilge
Smith orally rendeied his ieci!-ion
on June 3d. On June 4th the
Ottawo Journal brought arepoit
i hereof which was, irom some
casse, so imperii tit that they apol
ogized to the judge therefor, and
to mend matters on the 5th f
June reproduced the report uom
toe manusciipt the judge himseh
had now written out and furnished.
Judge Smith taidin this published
report that "1200" should read
"2uM0," and "annual conference"
should read "general confeieme."
