A Proposed New Town.

of grading Washington street, was
argueu betore Jtidiro lioiso yester-
day, and was submitted laBt even-
ing. The status of the case is this:
Ihe referee has hied his report,
finding that the city has the right
to grade the street, and that the
injunction should be dissolved, but
that a lien for the work of such
grading cannot, under 'the charter,
be placed u;;on the property. The
attorneys for the city have moved
to confirm the report, except this
clause referring to the lien, and
the tjlaintrffs attorneys hive
' moved to set isido the: report ex-
; cept .this clause and to conhrm it.
The case was argued at length and
was taken- under advisement by
th court. Daring the course of
' the argument the court ruled that
the only point to be contested was
whether or not the proceedings of
; the city council in ordering the
giading were legal, and the case is
i now narrowed dovn to this point
of law.

The advantage in establishing
the factory here is the superior
shipping facilities oilered in Al
bany. Tiie enterprise is an impor
tant one, and there will doubtless
le no hesitancy in making up the
remaining stock. The matter has
been left with Mr. Frank J. Miller,
of this city, and Mr. Hochstedler,
who will present the matter to the
citizens of the city, and if tins
amount is subsciibed the factory
will be established "at once.

engagement was a great success,
and she received numerous offers
from Eastern managers, who

her native state. She is to-day con
sidered one of the best emotional
actresses in this country. Mr.
Grismer is an actor of power and
tine perception in impersonating
his characters, and the company
has met with overwhelming suc
cess everywhere.
This will probably be their last
engagement in this city until lS'.rj.
as they leave in April for a tour in
Australia. The press of San
Francisco, where they have been
playing, says that Mr. Gristlier
may v. ell feel very happy over The
Burglar. It is a play " that will
ku a good deal of money. Mrs.
Hodgson-Burnett has struck a gold
mine in this drama. It appeals to
ail classes of people. It is compre
hensible to young and old, and as
in this play the paternal and
matermd instincts arc powerfully
appealed to, there does not seem
to be anybody but old bachelors
left without any ostensible interest.
They are very likely to steal in, if
it is only to congratulate them
selves that they did not get mar
ried. Old maids will require a box
of handkerchiefs each. It's a good
"souvenir" play, for a good
strong eye wiper will always come
in useful. The work done by Mr.
Thomas in setting this little bit of
dramatic jewelry has been most
creditable. The play which leads
up to and planes oil that pretty
scene of the child and t'e burglar
is interesting. The relations are
made of su'licient importance to be
followed closely. There is enough
of Th? Burglar to interest deeply
without ovei loading the play. In-dee-,
it is very much to Mr.
Thomas' credit that ho has never
been carried away by theme'o-j
dramatic. It is all through well
acted and Mr. Grismer and Missj
