QUESTIONS CONSIDERED.
It will not be amiss to consider
some of the questions that are
brought into prominence bv Gov
ernor Pennoyer's recent message
to the legislature. The most
prominent one, perhaps, is the
question of the constitutionality of
commissioners to perform distinc
tive and enumerated duties. The
go'emor, by some process of
reasoning, uton which he probably
lias an exclusive copyright, has
convinced himself, or at least
endeavors to convince the legisla
ture, that commissions are uncon
stitutional. Following out his line
of argument, probably every
upecial committee appointed by the
legislature to investigate any
special! named object as the
asylum, penitentiary, deaf mute
school, etc., are unconstitutional,
as the legislature cannot delegate
its authority. This would be the
conclusion if the governor's con
clusions are correct, but the fallacy
and untenablenes of his assertions
are so apparent as to cause a
broad smile on there mention.
All of the states that have en-!
acted laws upon railroad matters
have finally adopted the commis-1
nion plan' of operation, alter
attempting the maximum rate
business, that the governor recom-1
The facts of the case are that the
commission in Oregon lias been a
success, as far as the law would
allow them to be, and the initia
tive action taken by that law
should be followed up, strength
ened and made permanent.
One thing however, the governor
has emphatically demonstrated,
and that is that the commissioners
should not be subject to appoint
ment by the governor, but should
be elected by the people, and it is
to be hoped that the law will be
amended in that respect while its
other provisions are being con
sidered. It is ierhais a matter of congra
tulation to discover that the
governor has concluded that the
supreme court decisions are worthy j
of consideration, even if they do
tun in the channel of his desires
in belittling the functions of the
railroad commission. The impres
vvm lias Ijeen somewhat prevalent
that his opinions were in a line
with the demand ma-ie uKn the
legislators thai they should pass
"A law to prohibit the courts ni
this state from anuuling or sus
pending the operation of any law
passed by the legislative asem
lly." It the position he now
takes is an indication that he re
cognizes that fundamental principle
in our government, that placed the
check of the interpetration of the
limit of the tower that the people
delegated to the legislature, in the
hands of the supreme court, thus
lessening the chance for arbitrary
and revolutionory ation by the
legislative power, it will be hailed
by the people as a return to good
tto.ind judgement on the part of
the chief executive, for the ques
tionable decisions of the courts
have rankled so deeply in the
breasts of the people that an ap
peal to tl.em in the line of the
quotation given above is like hold
ing a inati h to a powder magazine,
and might result in hasty and
revolutionary action that might be
subversive and destructive to good
government. The fundamental
principles upon which our govern
ment are founded are sound and
should be maintained.
