appeared to-day before the army
returning board for examination
for retirement in obedience to an
order by the secretary of war. Mr.
fcfwaim stated that he had requested
the president to restore him to his
former status, after which he
would be willing, but he did not
care to be examined before being
pardoned. The physicians stated
to the board that he had indica
tions of kidney disease, which
would unfit him for active duty,
but asked for more time for inves
tigation.

a decision in the case of Jas. K.
Martin, guardian for Calvin James,
and the city of Cheyenne, Wyom
ing, vs. Francis Leon, which in
volved liens near Cheyenne, and is
used for waterworks. The decision
sustains that of the commissioner
of the general lahd office, rejecting
no land application, but leaves the
claim of Cheyenne undermined.

This state institution has now an
endowment of more than one hun
dred thousand dollars, the proceeds
of the sale of the Agricultural col
lege lands donated by the General
Government to the state. It also
receives $15,000 per annum from
the Federal government under the
Hutch act. It has a commodious
building, erected by the generosity
of the citizens of Corvnliis. All
that is now needed to give it a lair
start is to furnish it with necessary
land for its la:m. It wouid.be
proper therefore, tor the legislature
to appropriate $10,000 for such a
purpose. When this shall have
been done, together with the abol
ition of tree scholarships, the Ag
ricultural college at Cor vat lis, like
the State University at Eugene.will
be able with frugal management to
enjoy h prosperous existence, with
out being a perpetual pensiouer up
on the taxpayers of the state.
And the great fact should be im
pressed upon the legislature that it
will be compelled, sooner or later,
to choose between the alternative
of supporting no higher schools at
all than our common schools by
taxation of the people, or that the
number of such high schools, sup
ported by tax, will be indefinitely
increased. The people of other
sections of thestate will argue,and
with justice, too, if high inst tutions
of learning are supported by the
public treasury at Corvallis and
Kugene City, that it is no more
than just or proper that normal
schools should be supported by the
public treasury in other cities in
different parts of iliu st;tie. This
latter course would open tiie door
oi the treasury to an unlimited ex
penditure ol money for the support
of an unlimited number oi nidiii'er
ent schools. The safe course to
pursue is the just course. No gen
eral tax should be levied lor the
support of any school but those oi
general benefit

ly without foundation. By author

ing the president's message on
Samoan affairs, which was laid be
fore the lGth inst, discloses the
fact that Germany has made a
declaration of war against Samoa,
and h is entered official complaint
again.-1 the United States because
an American named Klein led the
Samo.ni forces which killed twenty
and wounded thirty of the German
marine. Action by congress on
the subject is expected. The Ger
man government also begs the
United States to join in an active
way to restore calm and quiet in
the island. The American govern
ment disclaims any responsibility
for Klein's acti in. claiming he was
not nor never had been connected
with the United States public ser
vice. The correspondence also contains
instructions to Admiral Kimberly,
from secretary Whitney, in which
the latter says: "You will atone
proceed to Samoa and extend full
protection and defense to Ameri
can citizens and projierty. You
will protect against the subjugation
and ilLsplacotiio- t of the native
government oi Samoa by Germany
as in violation of the positive agree
ment and understanding between
the treaty powers, but inform the
representatives of the German and
