from Marion county ; judgement of

Strahan, j. This decides the S;f
verton city election contest. At
the city election held in Silveiton
last May the prohibitionists used
ballot paper which had been left
over from that purchased from the
secretary of state for the use of th
general election of 183(5 and was
tinted. The citizen's ticket was
printed upon white paper furnished
by the secretary of state. The
canvassing board refused to count
the ballots printed on tinted paper,
tnus electing the citizen's ticket
mire, although several of the
prohibition candidates had a ma
jority of the votes cast. An actior
was commenced in the circuit
court to have these ballots counted
and Judge Boise held that the bal
lots were Iesral and should havn
been counted. The case was then
appealed to the higher court which !
affirmed the decision of the lower j
court. The effect of the decision is i
that paper once purchased of tiie
secretary of state can be used at
subsequent elections. Following is
the syllabus: The ballot paper
duty of the secretary of state, sec
tion 2507, Hill's code, has shifted
the duty of the selection of suitable
ballot paper from the individual
voter to the secretary of state.
Ballot pai-er, use of surplus at suc
ceeding election, under section 2507
supra, a political committee may
purchase of the secretary of state
"such quantity or amount of paper
as may be necessary or convenient"
and ils use is not limited to a pend
ing election or the next ensuing;
the surplus, if any, may be used at
any subsequent election. If tintsd
paper be selected by the secretary
ot state and lurnished tor
ballot !
paper, ballots printed on it are law
ful and must be counted.
