JUDGES AND JUSTICE:
.The many legal decisions that
fail to satisfy the popular idea of
justice naturally cause an inquiry
into the whys and wherefores of
such decisions. The inevitable
first or hasty conclusion is that the
fault lies at the door of the judges
wiio render the decisions and the
charge of vernality is at once
entered.
That cases of biased findings are j
made is, without doubt true, at
least subsequent events, and the
demands of the public will upon
the subject, would so indicate.
But the great majority of the cases
submitted to legal inspection are
rendered in a manner to create a
respect and faith in the judicial
branch of our government, and to
make it the great bulwark of our
national strength and safety, irre
spective of the clamor that may be
raised under the excitement of the
moment, before the full bearing of
a legal decision has been fully con
sidered. Judges, of course, are but human
;and subject to the same feelings,
desires and biasing influences that
every other human being is, and it

ity, if self interest did not bind
the iudicial eve at times and
swerve the lin'j from the true
ing to exact justice.
Judge Barrett attempts to give
some ot the reasons for this swerv
ing when he says: "It ought to
been, and is, wholly 'unmixed of
evil.' Leaving out othej consid
erations, it is not unfair to say unit
three-quarters of all the legislative
conuption from which we have
sulfered during the past fifty years
has been directly chargeable to the
railways; and that a vey large
proportion, perhaps nearly as much
as half, of the litigation that has
occupied our courts during the
a ne period has been directly con,,
netted with railway matters. AVe
could well afford to forget and for
give both the corruption and the
litigation, if we now enjoyed a pei
fected railway system, smoothly
working like a vast machine for
the general welfare. ' But, unhap
pily, the machine does not. work
smoothly; on the contrary, it is
sadly out of joint in a dozen dif
ferent places, and in as many dif
ferent ways, at the same time ; and
the machine is so vast and com
plex, it so completely covers the
whole country, and is so directly
and so intimately connected with
all our financial and business in
terests, that there is never a time
when some of these interests are
not in a state of uncertainty or
disquiet, not infrequently in a state
of anxiety, and sometimes of col
lapse, by reason of trouble, finan
cial or otherwise, among the rail
roads." Government could, by whole
some legislation upon the ribjct,
so control this immense and still
growing railway system so that all
parties interested should have fair
and equal treatment, so that the
interests of the minority stock
holder should be guarded so that
no majority could "water" his
stock out of existence. That gov
ernment control must come sooner
or later
