Sait Aeainst Wallis Nash for his Interest
ia the Taquina Bay Wagon Eoad Grant
In the case of the Oregon agric-
cuhnral company vs. Wallis Nash,
Judge IJeady Jrriday sustained a
demurrer to the bill and allowed
plaintiff twenty days to file a new
bill, remarking that it was replete
with needless repetitions and
statements of irrelevant matter. It
appears in this case that in 1878
Egenton Hogg and Wallis Sash
were the owners of the 60,000
acres of land known as the Cor-
vallis and Yaquina bay military
road grant, and they sold the same
and agreed to convey it to the
plaintiff, a company formed in
London, for 24,000,"to be paid in
stock of the company, said com
pany also agreeing to raise 15,000
on this property and invest the
same in stock, farming implements,
etc., and bv improving the land
and stocking it, to make it produce

modifications of this contract back
and forth till 1882, when it was
about rescinded, and Hogg took
30,000 acres of the land and the
r.st went to members of the corn

Nash was no party to this sub
sequent arrangement, nor did he
ever agree that they should be ex
cused from raising the 45,000 and
putting it into the scheme, which
iliey never did. The company
claimed that Nash has some nom
inal interest in the land, to which
they are entitled, and bring this
suit to make him relinquish it to
them. The court said it did not
appear from the bill how he had
any other interest in the land than
a legal title to it if anything, and
as it did not appear that the com
pany had ever fulfilled their con
tract nor Nash ever excused them,
the demurrer was sustained.

Three Parties at Work on the Oregon Pacific
Eailroad Eastward of This City.
Chief Surveyor E. J. O'Conner,
who has been surveying on the
Oregon Pacific railway eastward of
this citv.returned last evening. He
stated to al lER ALDi eporter that there
are now three surveying parties on
the line between this city and the
summit, who are operating re
spectivly near Meharaa, Rock
Creek and liunt'B old camp. They
are engaged in cross-sectioning and
re-establishing the old lines.
"This indicates an early resump
tion of railroad construction, does
it not," asked the reporter.
"If this surveying is not prepara
tory to resuming . construction on
the road, the work ia all thrown
away," he replied. .
It is not likely that the company
would put these three surveying
parties in the field at this time un
less railroad work is to be resumed
this spring.

A Borrow Cape.
Yesterday afternoon as a little
sou of Frank 411en was sitting on
the express hack at the Oregon Par
cific depot, the horse became
frightened at the whistle of the
locomotive and started to run. The
little fellow tried to stop the big
horse, but he only ran the faster.
Conductor Kennedy, seeing his
danger, ran up the track and as
the horse attempted to cross the
railroad seized him by the bits and
stopped him, no damage being
done.
