S kction 8 . The recorder shall be ex-offlcio clerk of the common
council, and iball perform all the duties required of him as such, and as
may be prescribed from time to time by ordinance. He is authorized
to administer anv oath required to be taken in connection with the
duties o f his office; he shall have all the power and jurisdiction of a
justice of the peace iu all civil aud criminal matters arising within the
city limits, and in all matters civil or criminal, when acting as justice of
the peace, he shall be governed by the laws relating to justices of the
peace. He shall have jurisdiction of all actions brought to enforce or
recover uny forfeiture or penalty declared or given by an ordinance of
the city, nud shall have origional and exclusive jurisdiction of and over
all violations of the city ordinance, and may examine, hold to bail, fine
and commit persons found guilty thereof; and iu all such proceedings
he shsll be governed and regulated hv the general laws of the state
applicable to the justice o f the peace or justices’ courts iu like or simi
lar cases; but in proceeding for the violation of a city ordinance, the
trial shall be without a jury. The common council may limit, by ordi
nance, the number o f witnesses to be subpoenaed, at the expense of the
city, on the pait of any defendant on trial for a breach of a city ordi
nance, and may regulate the fees o f witnesses. There shall be no right
o f appeal from the decision of the recorder for a violation o f any ordi
nance o f the city unless the sentence be for imprisonment for ten days
or more, or for the payment of a fine exceeding twenty dollars; but in
case the defendant may appeal to the ciicuit court, upon giving aud
undertaking with sureties to be approved by the recorder, conditioned
to pay all costs that the defendant will render himself in execution of
any judgment that may be rendered and satisfy any judgment that
may be affirm-d, and not otherwise. Said appeal shall be taken in Ihe
same manner as appeals are now taken from justices’ courts. The re
corder shall keep a true accouut of all fines, costs and other moneys
received by him, and be must pay the same to the treasurer monthly
aud lake duplicate receipts therefor, one o f which he must file with the
mayor. He shall keep a separate docket of all the city cases, and
make a report in writing to the common council at its first meeting in
each month of his doing- therein.
The marshal shall have all the powers and authority
o f a constable within the limits of the city, aud it shall be his duty, in
addition to the duties prescribed by the common council, to execu’.e
and return all processes issued aud directed to him by the recorder or
by any legal authority. He shall attend on the recorder’s court and
the meetings of the council. He shall arrest, on complaint or other
wise, as other peace officers, all persons found guilty of a breach of the
peace or the violation of the city ordinances or the laws of the State,
and bring them before the recorder or other legal authority for trial.
He shall be the keeper o f the city prison, and a conservator of the
peace generally

him or his deputies, showing the time when and the cause of complaint
upon which such were made; and must make a complete and full re
port thereof in writing to the council at its first meeting mea-E m~n<h.
He may appoint such deputies as the council may allow, to act as
night watchman or day watchman, who shall receive such compensa
tion for their services as the common council may prescribe; but any
and all appointments of his deputies shall first be submitted to and ap
proved bv the council, and when approved such deputies shall take an
oath of office, and the marshal shall be responsible tor their conduct.

and alleys, and to see that all streets, side and cross walks of the city-

COMMON COUNCIL.— POWERS A N D DUTIES.
At the first regular meeting of the common council
alter the first day o f June following each election, or as soon thereafter
as practicable, the councill shall choose by ballot one of its members to
preside over the council and perform the duties of the mayor in the ab
sence o f the mayor or his inability to act. He shall be designated as
chairman of the council, aud in the absence o f the mayor from the city
or if he be from any cause unable to act, said chairman of the council
shall have and exercise the powers aud perform all the duties of the
mayor; and should both-of such officers fail to attend any meeting, a
quorum of the council may elect a chairman from their number for the
purpose of meeting, who shall be designated as chairman of the council
pro tem The council shall name and appoint the time aud place of
holding their stated meetings, and may be convened by the mayor, or
in his absence or inability to act, by the chairman o f the council, at
any time, and in such manner as may be piescribed by the mayor, or
in bis absence or inability to act, by the chairman of the council, at any
time, aud in such mauner as may be prescribed by the council. A ma
jority of the members of the common council shall constitute a quorum
to do business, except when otherwise provided, but a smaller number
may meet and adjourn from time to time and compel the attendance of
absent members, in such mauner and under such penalties as the coun
cil may have previously prescribed. The council may prescribe rules
lor their proceedings, punish any member or other person for disorder
ly conduct in their presence or at any meeting of the common council,
and, with the concurrence o f two-thirds of all the members elected to
the common council, expel a member. They shall cause a record to be
kept of their proceedings, and at the tequest o f any member, shall
cause the yeas and nays to be taken on any question before them and
entered on the journal. Their proceedings shall be public. For the
purpose of a quorum, the mayor shall be considered a member of the
common council.

The common council shall have the power within
the limits o f the City of Coquille:
1 . T o make by-laws and ordinance and pass resolutions not re
pugnant to the laws of the State or the United States.
2 . T o levy and collect taxes, not to exceed seven mills or seven-
tenths of one per cent per annum, upou all property made taxable by
law for county or state purposes.
3 . T o provide for disbursing of all moneys to which the city
is cr may become entitled by law or which may be assessed or author
ized to be collected for city purposes within said city.
4 . T o borrow money on the faith of the city or loan the credit
thereof, or both, for purely muuicipal purposes.
5 . T o aDpropriate money for any item of city expenditures and
to provide for the payment of the debts and expenses of the city.
6 . T o license, tax, and regulate auctioneers, taverns, ordinaries,
wash-houses, livery and feed stables, feed yards, butcher shops, engines
and boilers, drays, hacks, wagons, hawkers, peddlers, pawn brokers,
money-changes, traveling salesmen, solicitors and retail venders of
goods by sample, or for future delivery, and to define what shall con
stitute the same; to regulate aud restrain traffic on Sunday, and to li
cense, tax, regulate, and restrain all offensive trades and occupations.
7 . T o license, tax, regulate, restrain, suppress, and prohibit
theatrical and other exhibitions, shows, amusements, bar rooms, gro
ceries, tippling houses, “ and further provided that no license shall be
issued tor a less sum than that provided for under the general laws of
the State,” billiard-tables and other tables on which balls aud cues are
used, bowling alleys aud shooting galleries, rendering houses, and pig
pens. T o prohibit and siipj^-ess gambling and gambling houses,
houses of ill-fame and bawdy houses; provided, that any house or room
kept or occupied by one or more woman for the purpose ot or prostitu
tion shall be deemed a bawdy house within the meaning of this sec
tion.
8 T o license and regulate all such callings, trades, occupations
and employments as the public good may require to be licensed and
regulated, and as are Mat prohibited by law.
9 . T o tax, regulate and control slaughter houses, wash houses,
rendering bouses or shops or pig pens, and to provide for their re
moval from the city litiits, or from any part thereof.
10 . T o make resolutions to prevent and remove nuisances, and
to declare what shall constitute a nuisance; to pievent the introduc
tion or spread o f contagious and other diseases in the city; to re
move persons afflicted with such disease therefrom to a suitable hos
pital previded by the city for the purpose; aud to secure the general
health o f the inhabitants.
