NO. 43.
An Ordinance Authorizing the President of the Board of Trus
tees of the Town of Coquille City, Coos county, Oregon, to
Execute for and on Behalf of the Town of Coquille City, an
Agreement Between Said Town and One J . L Davis for Fur
nishing the Towu With Electric Lights for Its Streets, Ronds,
Alleys, und Other Purposes for a Term of One Year.
The Town of Coquille City tl'te* ordain an follows:

Section 1 . That the president of the board of trustees of said
town of Coquille City l>e and ia hereby authorized to enter into
and execute for and on behalf of said town an agreement with
one J . L. Davis for furnishing electric lights for said town, which
said agreement shall be executed in words ami figures ns follows :
This Agreement, made and entered into this 7tb day of March,
19H0, between J. L. Davis, of Calaveras county, in the state of
California, tho party of the first part, and the towu of Coquille
City, Coos county, Oregon, a municipal corporation duly organized
and existing under and by virtue of the laws of the state of
Oregon, the party of the second part, Witnesseth:
That the party 0 / the first part agrees to erect, iu the town of
Coquille City, on or before the 12th day of August, 190(1, n well-
equipped anti modern electric light plant of sufficient power to
furnish all private parties with all the electric lights for which
they shall desire to subscribe, at a maximum rate npt to exceed
$ 1.00 per month for the first two burners, aud at a maximum rate
not to exceed the sum of $0.25 for all additional burners for
which they shall desire to subscribe, aud to furnish all street
lights as hereinafter provided for.
The party of the first, part further agrees to furnish said
town for a period of one year from the time the said electric
light system shall be in first-class runniug order, twelve sixteen
candle power electric street lamps, and thirteen thirty-two candle
power electric street lamps, said lamps to be distributed through
out the original towu of Coquille City, Elliott’s Addition thereto,
Noslar’s Addition thereto as far ns southeast corner of Block
Three of said Nosier Addition, on the unplatted strips bordering
Elliott’s Addition to said town, nnd two additional sixteen candle
power lights in tbo recorder's office, all for the gr< ss sum of
twenty-five dollars per month, payable monthly at the ond of
each calendar month during the term of this agreement.
The party of the first part further agrees to furnis such addi
tional electric street lights within tho limits before named, as the
board of trustees tuny from time to time require and at oue dollar
per sixteen candle power light and one dollnr and fifty ceuts per
each thirty-two candle power light por month, to be paid monthly
at the time hereinbefore mentioned, provided the partv of the
second part shall pay the actual cost of putting the lights on the
poles.
The party of the first part further agroes to extend said electric
light system to any other points within the corporate limits of
said town that the board of trustees may require, provided the
party of the second part shall advance the cost of putting up the
said extensions; but should said extensions lie used nlso for pri
vate purposes, such rebate shall be made to tbe party of the sec
ond part as shall be agreed upon between the parties.
The party of the first part further agrees to maintain said
electric light plnnt in first-class running order, nnd agrees that a
ratable reduction shall be made for all time or times that the said
system, or any part thereof, shall fail to operate in first-class
manner and to furnish all lights herein contracted for.
The partv of the second part agrees, in consideration of the
foregoing, to pay the party of the first part the sum of twenty-
five dollars per month, payable on or before the last day of each
calendar month for the lights hereinbefore mentioned, and agrees
to take and subscribe for said number of lights of said descrip
tion for a period of one year from the time said electric light
plant shall be in first-class running order, nnd upon the execution
of this agreement by the party of the first part, agrees to grant
to him a right and privilege to place poles in the streets of snid
town, also in the roads and alleys, and to run electric light wires
therein for tho purposes of said electric light system. Said right
and privilege shall be for a period of fifteen years from the dnte
hereof, the first seven years of which shall be exclusive to the
said party of the first part.
It is further ngreed between said parties that the pnrty of the
first part will change the location of any or all of said electric
street lights at any time the board of trustees may require it, pro
vided the party of the second part will stand the actual expense
of said directed change.
It is further agreed between said parties that the snid party of
the second part shall have the option to renew this agreement,
under the same terms nnd conditions, for one or more additional
years, during the term of said fifteen-years fran 'line.
And whereas, it is understood between snid parties that tbe
party of tho second part is desirous of linving said town lighted
by electricity not later than August 12, 1900; anil whereas, other
propositions have been made to snid town for said purpose, and
whereas the party of the second part is aware of this, now, there
fore, all items of time herein mentioned, and particularly the time
in which the said electric light system shall bo in first-class run.

August, 1900, or a failure to perform any or all the terms nnd

option of the party of the second part, render this agreement
null and void,- and the party of the second part shall have the
right to repeal tho ordinance granting snid franchise.
