Indianapolis, Ind., Nov. 12.—The
case of Lewis C. Bramkamp of Cin­
cinnati against the American Wire
Nail company, the Indiana Wire
Fence company and a dozen
other individuals and corporations
throughout the country, alleged to
compose the wire nail trust, came
up before United States Judge
Baker in chambers today.
The plaintiff is a manufacturer
of wire nails of Cincinnati, who al­
leges that he entered into contract
with an Anderson, Ind., firm for
forty-two wire nail machines. He
alleges that the wire nail trust, by
money and threats, caused the An­
derson company to violate the con­
tract and prevented him from secur­
ing machines elsewhere, thus ruin­
ing his business. He alleges that
one of the purposes of the trust is
to freeze out in this way manufac­
turers who will not come into the
combine. The trust, he claims, was
organized early in 1895, and he
asserts that since that time it has
forced up the price of wire nails
over 300 per cent abovo a fair sell­
ing price, netting $7,000,000 to the
persons in the trust.
The defendants today admitted
that the allegations of the bill are
true, but asserted a lack of juris­
diction on the part of the court,
which the latter overruled.
In an informal opinion Judge
Baker hit hard at trusts. He said:
“ The trust described is an unlawful
combination and conspiracy
to
raise the price of goods and to
interfere with the manufacture of
wire machinery, and is in direct vio­
lation of an act of congress, of good
morals and of the public weal.”
After scoring the trust at length,
the court directed that a temporary
injunction issue until the case cau
