which shows the turning of t!ie
scale toward justice for women.
It was a trial t r murder. A young
woman can he wronged. 1’ho man
betrayed her by lying promises
and then, by marrying another
woman, abandoned her to her
shame. Months afte»- the wronged
woman shot dead the wretch who
had sjioiled all her life.
The charge to the jury occupies
two columns of the Avalanche. It
is sfdd to be “tin innovation upon
the long-established idea in regard
to tlie law gov Tiling such cases."
The judge sail! among other
things:
“ Now, if I may he found guilt)
of voluntary manslaughter onh ior
killing him who strikes me a blow,
or contests with me for my horse
or watch, or who attempts to vio
lently trespass upon my house,
may not a trusting woman strike
back with deadly effect upon him
who gives her a moi il death, who
blasts and blights all her hope>
and drones her life in her eternal
mourning? Is my horse or my
premises to he more sacred from
the intruding and larcenous hand
of the thief than the good name
anil virtue o f a woman from tin*
lecherous machinations of the wily
and profligate seducer?"
The jury were out but a short
time until they reported they had
agreed upon a verdict. Ueturniug
into court their verdict was hand-
ed^to the clerk, who read: “ We,
the jury, find the defendant not
g u il'y as charged iu the indict
ment.” N o sooner was the v« rdict
rendered than the crowd burst into
the wildest yelis, many throwing
their hats to the ceiling.
Two
deputy sheriffs attempted to keep
silence, but to no purpose, r inally,
silence being restored, except the
defendant and her father Squire
W inters stated that the defendant
and her father desired to shake
hands with the jur *rs and the two
ladies, Mrs. E. E. Saxon and Lida
Merriweather, who had given her
their presence since the trying
ordeal. The court said they might
do so.
They accordingly came
around in front of the jm ig -'s
bench and shook hands with the
jurors, and then Mrs. Saxon and
Mrs. Merriweather came down to
the judge s stand and congratulat
ed the defendant, and had with
her a few minutes’ whispered con
versation. Then the y o in g woman
and her father shook hands with
Judge Douglas while the tears ran
from his eyes.
Court was then
adjourned, and the court room in
less than half an hour was “ like
some banquet hall deserted."
The verdict was as it should
have been. Mrs. Saxon and Mrs.
Merriweather sat with the judge
during the trial, thus giving their
moral support to the case.
The M emphis Appeal says:
A few years ago the seducer in
this case would have been a hero,
and the victim a murderess drag
ged to the scaffold. But her tri
umphal
acquittal
shows
that
woman is emerging from the de
gradation of the dftrk ages.
Men
are never punished fo r lynching
the rapist, and for the
future
women will not he punished for
murdering villains who
seduce
them under the promise of marri
age. The fiat has gone forth that
the seducer under the promise of
marriage shall surely die.
The
acquittal on Friday last, and the
popular endorsement o f ! i . * * verdict,
emphasizes public opinion on this
question.
