As there is some controversy in
this section, upon the length of
time certain acts of congress have
been in force, it would be an item
cf useful information if you can
hunt up and print the following:
The date of the pre-emption act.
The date of the homestead act.
The date of the donatiou act, with
strict reference to Oregon. At the
same time be kind euough to fur
nish your readers with the date of
the granting the swamp land to the
state of Oregon. As I expect to
make, or, which would be more
appropriate, to express an opinion
on the swamp land act, and the
loose manner in which the framers
of the bill guarded or did not
guard at all against fraud from
w hatever source, I would prefer
to approach the subject carefully;
but I have no data at hand ot
guide me through the labyrinth
of complex details.
It does appear to me to have
been tho correct thing for the
receivers and registers at land offi
ces to have questioned an appli
cant for pre-emption as to the
quality of the land, after the pas
sage of the swamp land act. Hav
ing, with five others, filed on pre
emption
claims
in 1872,
I
can assert, with truth, that
no such questions were put. Why
not? Would such ruling not have
acted as a preventive against both
ignorance and fraud.
Ignorance
of an act of congress will not pre
vent the punishment of those who
treat that act with contempt; yet,
it stems to lie a weak point in a
governing body to throw no safe
guards around that portion of its
citizens and they are a multitude—
who know not anything about,
acts of congress.
It will not
suffice, in answer, to say that
many persons filed on those lands
knowing their character, and who
made final proof, with abundant
witnesses to swear to anything. The
damaging point still remains, that,
the government made no effort to
prevent this, and left itself open to
the accusation that, it donated land
to one party uud then sold and re
ceived the price for it from anoth
er. It will work great hardship
on some of the settlers w ho have
taken up and improved swampland
in this county, if they are ejected.

our progress has been slow, owing
to the distance ot the market; but.
