ORDINANCE NO. 125
This is an Ordinance entitled "An Ordinance
to pre vide certain compensation for members of
the fire department, to regulate the same, and
to amend Sec. XIV of Ordinance No. 52,
entitled 'An Ordinance to create, provide for
and regulate a Fire Department for the Town
• of Bandon,'"
The City of Bandon does ordain as follows:
Section I. That the members ol the fire
department of the city of Bandon, doing actual
service in fight ng lire, and also for answering fire
alarm rails, shall be entitled to One (I) Dollar
for such services and paid as hereinafter pro­
vided.
Sec. 2. That after the elapse of thirty (30)
■lays of active practice, in such fire drills as may
be determined upon or directed by the chief of
the fire department, after the formation and or­
ganization of this department, then each member
shall be entitled to one (I) dollar for each drill so
participated in by him, not to exceed however
two (2) drills per month for which he shall re­
ceive such compensation.

Sec. 3. That as to the number of drills, and
the attendance at fires as provided in the foregoing
section, the report of the chief of the department
shall be made monthly to the common council,
and this report shall be deemed prima facie cor­
rect, but may, upon application of any member
of such department, under affidavit of mistake,
in-accuracy or other defect, be reviewed, cor-
r cted or amended by the said council, and the
decision of the council shall be final.
Sec. 4. That the proper officials of the city
shall, make and deliver to such firemen as may
be recommended in the report and as adopted by
die couucil, city warrants upon the treasurer in
the amounts adopted by the council.
Sec. 5. That Sec. XIV of Ordinance No.
52, entitled 'An Ordinance to create, provide for
and regulate a fire department in the Town of
Bandon* which passed the Board of Trustees of
said Town on the 1st day of May, 1901, and
was approved by the Präsident of the board
upon the said 1st day of May, 1901, shall be
amended to read as follows: 'Any person ring­
ing the fire alarm bell or gong used for such
purposes, except in case of fire without permis­
sion from the common council or chief of the fire
department, shall be deemed guilty of a mis­
demeanor, except the marshal may, upon the in­
struction therefor by the council, use the same for
curfew purposes.

shall be built as nearly as may be practicable 1a

ter at the small end of each pile. Caps for pil­
ing shall be 8x10 inches and shall be spiked or
firmly bolte t to the top of piling. Stringers shall
be 3x12 inches and 22 feet long and placed not
more than three feet apart.

from the level of the sidewalk; braces for posts
shall be 2x4 inches and the railing itself 2x4

placed along the full length of railing at a dis­
tance midway between the sidewalk and the top
of the railing and securely fastened and nailed,-
the said railing shall extend the full length of each
sidewalk on the south side thereof, and such
bridge and sidewalk above described is hereby
declsred to be an improvement.
Sac. 5. That the cost of the construction of
the said bridge shall be assessed to the adjacent
property, and that each lot on each side thereof
and fronting upon the said bridge shall be liable
for the cost of said bridge in proportion as its
frontage upon the said street bears to the total
number of feet frontage of both sides thereof ex­
cepting thejsouth eighteen feet of the said bndge.the
same being wijiin the intersection of the said At­
water street and Columbia avenue, the cost of
which shall likewise be assessed to all of the
lots fronting upon the above designated portion of
the above avenue, said asseumeats to be appor­
tioned among ths said lots in the same proportion
which the frontage of each lot bears to the total
number of feet frontage of all the dots (on both
sides of the said portion of the said avenue.
Sec. 6. That immediately after this ordinance
shall become of full force and elect, then the
city recorder shall be required to post legal no­
tices advertising for sealed bids upon the said
bridge, as above specified, any or all of which
bids may be rejected at the discretion of the
city council.
Sec. 7. That if the council shall deem it ad­
visable to accept the b.d of the lowest responsible
bidder, then the same may be accepted by a reso­
lution therefor duly passed by “an Aye and
Nay vote, and entered in the Journal of Pro­
ceedings, and thereupon the street com mlitre with
the assistance
of the
city engineer shall
proceed
to
determine
and assess
upon
each lot liable therefor, its actual and exact pro­
portionate cost of improvement, and the report
therefor may be enacted by ordinance, and de­
clared to be such assessment, and thereafter en­
tered in the docket of city liens against such
property.
Sec. 8. Provided that upon such assessment
having been duly declared and entered in the
city docket, the mayor of the city, together with
the recorder mav, by resolution therefor by the
common council enter into a contract with such
bidder for the construction of such improvements,
according to the above specifications and subiect
to such other provisions or conditions, including
indemnity bond as the council may deem ex­
pedient to impose, provided however, that such
contract shall not provide for. or permit any pay­
ment to be made upon such contract before or
faster than the assessments therefor may be col­
lected from the properry therefor liable.
