. Versus Christ Neilsen, the decision
of the Clatsop county circuit court
wua sustained
Nielsen, who is a
resident of the state of Washington,
was tried and convicted by the state
of Oregon for fishing on the Wash­
ington side of the Columbia river
with a purse net-.
By the laws of
Washington, in force at the time of
his arrest, Neilsen was guilty of no
offense, but by the laws of Ore on
this kind of fishing on the Columbia i
was contrary to the statute.
The single queMion for decision,
therefore, was whether the law ci
Oregon prohibiting the catching of
fish in the manner indicated ««tend­
ed over the entire waters of th«-
Columbia, or only over those on the
Oregon aide. By act of congress on
March a. 1895, Oregon and Wash­
ington have concurrent jurisdiction
over all offenses committed on the
Columbia.
As far as the state of Washington
19 concerned, Neilsen’s act is not an
offense, but under the law of this
state it is. The court has decided
that Oregon has jurisdiction in this
case, and that Neilsen’s fish'nv was
an offense against the law of this
state. The case will probably l>e ap­
pealed to the United States supreme
court.
