TRIBAL COURT ORDINANCE
OPEN FOR COMMENT
The Tribal Council is considering adoption of amendments to the
Tribal Court Ordinance. The proposed amendments were given a
First Reading at the June 19, 2013, Tribal Council meeting.
A summary of the substantive amendments under consideration are:
1. Qualifications for Judges: The current Ordinance requires
judges to be members of the Oregon State Bar. The proposed
amendment would require judges to be members of the CTGR Bar
as well as members of the Oregon State Bar or any other state bar
that grants reciprocity, to broaden the Court's ability to recruit
qualified judges.
2. Development of Tribal Court Bar: The Tribal Court Ordinance
currently provides that any attorney who is admitted to the bar of
any state may provide counsel to a party in Tribal Court. At present,
the Court has limited remedies with respect to attorney discipline.
The establishment of a Tribal Court Bar will allow for the establish
ment of standards, as well as the formation of a Bar Commission to
address concerns regarding attorney conduct.
The Tribal Council invites comments on the proposed amendments
to the Tribal Court Ordinance. For a copy of the proposed amend
