OPEN FOR COMMENT
Proposed Tobacco Ordinance
The Tribal Council, in consultation with the Tribal Attorney's Office, has pro
posed adoption of a Tobacco Ordinance. The first reading of the proposed To
bacco Ordinance was presented at the July 25, 2001 Tribal Council meeting.
The purpose of the Ordinance is to set forth procedures for regulating to
bacco sales on the reservation to ensure compliance with the Oregon Ciga
rette Tax Act. Compliance with the Oregon Cigarette Tax Act is a component
of the Cigarette Tax Refund Agreement between the Tribe and the Oregon
Department of Revenue, which provides for a refund of state cigarette taxes
to the Tribe based on a formula set forth in the agreement. Among other
things, the Ordinance does the following:
D Requires that any person that engages in the sale of tobacco products
on the reservation shall first obtain a tobacco sales license from the Tribe and
establishes procedures for obtaining such licenses.
D Requires that all cigarette packages sold on the reservation bear a rev
enue stamp of the State of Oregon.
D Sets forth procedures for revoking licenses, assessing penalties and en
forcing the Ordinance against persons engaging in the sale of tobacco prod
ucts on the reservation in violation of the Ordinance.
D Sets forth a time for all existing tobacco outlets to obtain a tobacco sales
license.
For a copy of the proposed Ordinance please contact the Tribal Attorney's
office at 503-879-2265. The Tribal Council invites comment on the proposed
Ordinance. Please send your comments to the Tribal Attorney's Office, 9615
Grand Ronde Rd., Grand Ronde, OR 97347.
Comments must be received by September 15, 2001.
