C-99-07-002 ORDER GRANTING NAME CHANGE In the Matter of: STEFFENSMIER Petition For Change of Name Juvenile Katherine Olivia Steffensmier, Applicant by Pamala Jean Warren, Petitioner Based on the allegations set forth in the Petition For Change of Name and New Birth Certificate - Juvenile filed by the Petitioner in the above entitled case, and based on the Court's examination of the Applicant, the Petitioner and other interested parties at the Show Cause Hearing held October 7, 1999. THE COURT FINDS THAT: 1. Petitioner is over 18 years of age and is the parent or legal guardian of Applicant, a minor child; 2. Petitioner is an enrolled member of the Confederated Tribes of the Grand Ronde Community of Oregon; 3. Petitioner has not been granted a change of name by the Tribal Court within the past twelve (12) months; 4. All persons entitled to notice have been properly served with a copy of the Notice -To Parents and-Legal Guardians. - . . ... 5. The father responded to his receipt of the Petition by returning it with notations on every page indicating his strong belief that mother's motives were impure, and his adamant objection to the name change. Ms. Warren verified that the writing was his. The Court's Aug. 16 Order to Show Cause was sent twice to him by restricted mail, and the Court has received two receipts dated Aug. 19 and Aug. 27, signed by his current wife, Renae Steffensmeier. The Court will consider father's written response as his ap pearance here today, even though not sworn under oath; and 6. The mother testified under oath. The Court found her testimony to be credible. Mr. Anthony Gagliardo of the ICWP also testified under oath, and his testimony supports the mother's. In sum, the mother is seeking this name change for the best interests of the child who is, and has been, in her legal custody since the divorce in 1991, is known to be the daughter of Pamela Warren, and has a sibling with a hyphenated last name of Warren-Masters. In addition, father's claim that "father is still alive" and therefore child should bear his last name, extends equally to mother, who not only is alive, but is the custodian of the child. Mother does not seek to eliminate father's name, but only to add her own as well; and 7. The proposed name change is in the best interests of the minor child. THEREFORE, BASED ON THE FOREGOING FINDINGS, THE COURT ORDERS: 1. That the name of the Applicant be changed from KATHERINE OLIVIA STEFFENSMIER to KATHERINE OLIVIA WARREN-STEFFENSMIER; 2. That the Clerk of the Tribal Court shall cause a copy of this Order to be published in the tribal newspaper; 3. That the Clerk of the Tribal Court shall submit a certified copy of this Order to the tribal enrollment office; 4. That the Clerk of the Court shall provide Petitioner with a certified copy of this Order to be submitted by Petitioner to the Registrar of Vital Statistics in the state in which the Applicant was born; 5. That the Petitioner, on behalf of the minor child, shall surrender all old tribal identification cards bearing Applicant's former name to the tribal en rollment office prior to the enrollment office issuing Applicant new tribal identification cards bearing the Applicant's new name; and 7. That within sixty (60) days from the date of this Order the tribal enroll ment staff, and, if necessary, the tribal Enrollment Committee, shall cause new tribal identification cards to be issued to Applicant showing the new name of the tribal member and shall change the official membership roll and all official enrollment records of the Tribe to reflect the Applicant's new name as stated in this Order.
