Smoke Signals Open for tribal member comment: Three proposed ordinance ameiritaGimte 4 Tribal Election Ordinance The Tribal Council, in consultation with the Tribal Attorney's Office, has proposed amendments to the Tribal Election Ordinance. The amend ments will: 1. ab Allow the Tribal Council to waive the so licitation of bids for an Election Adminis trator if the Council believes that there would be an insufficient number of bid ders to justify the time and expense of so liciting bids and any firm selected, is quali fied to perform the work required. 2. ab Prohibit candidates who withdraw from an election from reentering the election. 3. ab Allow the return envelope to serve as the Signature Verification Form if the signa ture on the envelope is notarized by a no tary public. These amendments are intended to clarify ex isting provisions and simplify the election process. Other technical amendments have been made to make the Election Ordinance more efficient. Comments must be received by May 1, 1999. Tribal Council Ordinance The Tribal Council, in consultation with the Tribal Attorney's Office, has proposed amendments to the Tribal Council Ordinance. The amendments provide that: 1. Council members must be nominated, (and the nomination seconded), for officer posi tions. All Council members, including the Chair, may vote on all officer positions; and 2. Incorporate portions of the Election Ordi nance pertaining to "Taking Office'' and "Va cancies," are now incorporated into the Tribal Council Ordinance. These amendments are intended to clarify the provisions regarding the election of Tribal Coun cil Officers, and incorporate provisions of the Elec tion Ordinance that appear to fit more appropri ately in the context of the Tribal Council Ordi nance. Other technical amendments have been made to make the Tribal Council Ordinance more effi cient. Comments must be received by May 1, 1999. Burial Fund Ordinance The Tribal Council, in consultation with the Tribal Attorney's Office has proposed an amend ment to the Burial Fund Ordinance. The first reading of the amendment to the Burial Fund Or dinance was presented at the March 31, 1999 Tribal Council Meeting. The proposed amendment to the Burial Fund Ordinance would increase the time allowed to apply for a burial benefit payment from 30 days to 60 days of the date of death. Comments must be received by April 30, 1999. The Tribal Council invites members to comment on the proposed amendments. TRIBAL GOVERNMENT, MANAGEMENT, AND BUDGET SUBCOMMITTEE Amendment to Resolution 065-98 Val Grout moved, Ed Larsen seconded a motion to adopt Resolution 024-99 amending the lease for the Elder Housing site to correct the legal de scription referenced in Resolution 065-98. Mo tion carried, 8-0-0. Rhoades Trucking Agreements Bob Merrier presented background information with regard to this purchase and outlined the steps to be taken by the Tribe. Bob Haller moved, Leon Tom seconded a motion to adopt Resolu tion 025-99 to approve agreements for: (1) the purchase of substantially all of the assets of Rhoades Trucking; and (2) the purchase of real estate at which Rhoades Trucking is located, as presented. Motion carried, 7-1-0. Mark Mercier voted in opposition. General Committee Ordinance Mark Mercier moved, Bob Mercier seconded a motion to approve an emergency Resolution 026-99 adopting the proposed language change to the General Committee Ordinance as follows: (A) Individuals may serve only on one (1) com mittee at a time, provided, however, an in dividual may serve on an ad hoc committee, Pow-wow Committee, or the Elders Commit tee and one other committee at the same time. Motion carried, 8-0-0. Enrollment Voluntary Relinquishment Ed Pearsall moved, Leon Tom seconded a mo tion to adopt Resolution 027-99 approving the recommendation from the Enrollment Committee to accept the voluntary relinquishment of tribal member 4509, Richard Jerome Taylor. Motion carried, 8-0-0. Extension of Polk County Building Exten sion Agreement Mark Mercier moved, Reyn Leno seconded a motion to adopt Resolution 028-99 approving the extension of the 1999 Polk County Building Inspection agreement to June 30, 1999. Motion carried, 8-0-0. Dedicated Roads onto BIA road system After information was provided, Leon Tom moved, Val Grout seconded a motion to adopt Resolution 029-99 recommending the addi tion of roads to the Bureau of Indian Affairs' road system as indicated. Motion carried, 8-0-0. Paving Contract Approval Dr. Ted Mala had reviewed the contract and recommend its approval. Bob Mercier moved, Ed Pearsall seconded a motion to adopt Resolution 030-99, approving a paving contract with Rowell & Wickersham Contractors, Inc., in the amount of $111,780.50. Motion carried, 8-0-0. Forest Land Acquisition After discussion, Ed Pearsall moved, Ed Larsen seconded a motion to adopt Resolution 031-99 approving the purchase of a 44-acre parcel, known as Tax Lot 200, located in the NE 14 of Section 6, T 4S, R 7W, W.M., in Tillamook County, Oregon, and to purchase the property following the ap proval of the title report by the Legal department and the completion of due diligence to the satis faction of the Natural Resources department. The property will be purchased for the purpose of a long-term timber investment for $56,000. Mo tion carried, 8-0-0. Amendment to Article XII to SMDC's Ar ticles of Incorporation Bob Haller moved, Reyn Leno seconded a mo tion to adopt Resolution 032-99, approving an amendment to Article XIII of SMDC's Articles of Incorporation to provide for removal of mem ber of the Corporate Board of Directors with or without cause by Tribal Council. Motion carried, 8-0-0. Amendment to Article VIII of SMDC's Ar ticles of Incorporation Bob Haller moved, Ed Larsen seconded a mo tion to adopt Resolution 033-99, approving an amendment of Article VIII of SMDC's Articles of Incorporation to reserve for Tribal Council the authority to approve any change in compensa tion of benefits for officers and employees hold ing director level or higher positions of SMDC or of any of SMDC's tribally-chartered subsidiaries. Motion carried, 7-1-0. Ed Pearsall voted in oppo sition. Coquille Elder Bus Sponsorship Leon Tom moved, Ed Larsen seconded to ap prove the funding (approx. $400) to cover trans portation for the Coquille Elders to participate in the Grand Ronde Elders' Honor Day to be held July 16-17, 1999. Motion carried. SMDC Monthly Board Meeting Attendance Ed Pearsall moved, Mark Mercier seconded a "roll call" vote on a motion to recommend that Council have at least five (5) members present at monthly Board meetings, because of the impor tance of SMDC. Recording Secretary, Lauri Smith called the roll. (7-1-0) RESOURCES SUBCOMMITTEE Hiyu Stick Logging Unit After comments shared by Mark Mercier, Mark Mercier moved, Bob Mercier seconded to adopt Resolution 034-99 as recommended by the Natural Resources Sukommittee to offer Douglas fir and other conifer timber from the Hiyu Stick Logging Unit on the domestic log market for a minimum price per thousand board feet of $571.89, provided the log market continues to improve. Motion carried, 8-0-0. Te-Ah-Wit Logging Unit Ed Pearsall moved, Leon Tom seconded to adopt Resolution 035-99 as recommended by the Natural Resources Subcommittee to offer an esti mate 2,863 board feet of Douglas-fir and other conifer timber from the Te-Ah-Wit Logging Unit on the domestic log market for a minimum price per thousand board feet of $559, provided the log market continues to improve. Motion carried, 8-0-0.
