Election Ordinance changes approved

The Tribal Council approved the
following amendments to the Election
Ordinance this month.
The amendments require the Elec
tion Board to "solicit bids from firms
to provide the Board with election
equipment and supplies, ballot col
lection, counting, and technical sup
port." Bids received will be submitted to
the Tribal Council and the Council
may select one of the firms to pro
vide technical support to the Election
Board. Alternatively, the Election
Board may, with prior approval of
the Tribal Council, negotiate an in
tergovernmental agreement with the
County Clerk to provide the Board
with technical support.
Any firm hired to assist the Board
will be limited to performing non-supervisory
tasks; the Election Board
will remain solely responsible for the
supervision of Elections, including
any work of any firm hired to assist
with elections. If no firm is hired or
no agreement is made with a County
to assist the Board within 75 days of
the Election, then the Board itself will
perform all work related to the elec
tion. The proposed amendments also in
clude a provision for requiring an au
tomatic recount of election results if
there is a difference of 1 or less be
tween 3rd and 4th place candidates
in a Tribal Council Election. In addi
tion to the automatic recount, any
candidate may request a recount.
Each request for a recount must be
accompanied by a $50 deposit (which
may be waived if it appears that be
cause of an Election Board error, the
outcome of the election will be
changed). If two or more demands
for a recount are made, the losing
candidate with the highest number of
votes shall be considered the demand
recount. If the election results are
changed as a result of the recount,
the $50 deposit shall be refunded. If
the election results do not change, the
cost of the recount will be billed to
the candidate requesting the recount.

This day will include videos provided by tribes, information tables and displays,
history and culture of Oregon tribes, sovereignty, treaty rights, tribal and state
relations, and issues of importance.

Employment Action Review Ordinance:
Resolution No. 032-98 approved
The Grand Ronde Tribal Council has adopted an emergency amendment to
the Employment Action Review Ordinance. Before this amendment, the Or
dinance allowed judicial review, , by the Tribal Court, of Final Employment
Decisions made on or after the effective date of the Ordinance (April 15,
1998). The Tribal Council believes it is critical for the Tribe to have good
relationships with its employees, including former employees. Upon review,
the Tribal Council decided that it is in the Tribe's best interest to amend the
Ordinance to made it retroactive to October 18, 1995.
The amendment to the Employment Action Review Ordinance establishes a
procedure for filing claims which predate April 15, 1998. There is also a
time limit to filing such claims and the remedies for any claim between Octo
ber 18, 1995 and April 15, 1998 shall be limited to reinstatement andor
payment of not more than one year's back pay. The following amendment to
the Employment Action Review Ordinance was made:
(g) RETROACTIVE EFFECT. This Ordinance is remedial and applies
retroactively to any Employee claims relating to the terms and conditions
of employment arising between October 18, 1995 and April 15, 1998. Any
Employee or former Employee who desires to assert any claim relating to
the terms and conditions of employment which predate April 15, 1998 must,
within thirty (30) days after notice is published in Smoke Signals of the
Tribal Council Resolution amending this Ordinance to give it retroactive
effect as provided by this subsection, either (1) initiate applicable Employee
action review procedures, including but not limited to grievance proce
dures, to resolve a dispute relating to the terms and conditions of employ
ment or (2), if a Final Employment Decision regarding such a claim had
been made before April 15, 1998, commence an action for judicial review
under subsection (d) of this Ordinance. Remedies for any claims arising
between October 18, 1995 and April 15, 1998 shall be limited, as appropri
ate, to reinstatement andor payment of not more than one year's back
pay.
The amendment was adopted by the Tribal Council on an emergency basis
pending final adoption according to the procedures of the Tribal Government
Ordinance. Under the Tribal Government Ordinance, tribal members must
receive notice of all major ordinance amendments. The Tribal Council in
