Under the Tribal Gov ernment Ordinance, tribal members must receive notice of all major ordi nance amendments. The Tribal Council, in consultation with the Tribal Attorney's office, has proposed amendments to the Tribal Election Ordinance. These amend ments are intended to improve the election process. The amendments require that the Election Board "solicit bids from firms to provide the Board with election equipment and supplies, ballot collec tion, counting and technical support." Bids received will be submitted to the Tribal Council and the Council may select one of the firms to provide the Election Board with technical support. Alternatively, the Election Board may, with prior approval of the Tribal Council, negotiate an intergov ernmental agreement with the County Clerk for Polk or Yamhill County to provide the Board with technical sup port. Any firm hired to assist the Elec tion Board will be limited to perform ing non-supervisory tasks; the Elec tion Board will remain solely responv sible for the supervision of Elections, including the work of any firm hired to assist with elections. If no firm is hired or no agreement with Polk or Yamhill County is made to assist the Board within 75 days of a Tribal Council election, then the Board it self will perform all work related to the election. The proposed amendments also in clude a provision requiring an auto matic recount of election results if there is a difference of 1 or less between the 3rd and 4th place candi dates in a Tribal Council election. In addition to the automatic recount, can didates also may request a recount. Each request for a recount must be accompanied by a $50 deposit (which may be waived if it appears that be cause of a material error of the Board, the outcome of the election will be changed). If two or more demands for recount of a Tribal Council elec tion are made, the demand received from the candidate with the highest number of votes shall be considered the demand recount. If the election results are changed as a result of the recount, the $50 deposit shall be re funded. If the election results do not change, the cost of the recount will be billed to the candidate requesting the recount. . , Other technical amendments have been proposed to make the election process more efficient.
