February 15, 1998 Notices 11 Proposed Ordinances open for comment The Tribal Council in consultation with the Tribal Attorney's office has proposed the en actment of a Tort Claims Ordinance. The Tribal Council recognizes that the Tribe provides services for residents of and visitors to the Grand Ronde Reservation, and that the Tribe is immune from suit in providing those services. However, if the Tribe so chooses it may waive its immunity. The purpose of the Tort Claims Ordinance is to establish a limited waiver of tribal sovereign im munity and provide a forum for visitors and resi dents of the reservation to file certain types of claims. In essence the Ordinance will provide a remedy to private people who are injured by neg ligent or wrongful acts or omissions of the Tribe, its agents, employees, or officers. The waiver will only apply to the types of claims outlined in the Ordinance. Claims filed pursuant to the Ordinance must be filed in the Confederated Tribes of Grand Ronde Tribal Court. The Tribal Council believes the es tablishment of this Ordinance will assist the Tribe in continuing to provide services which promote health, safety, and economic security for visitors and residents of the reservation. The Tribal Council recognizes that the Tribe is immune from suit by tribal employees in matters relating to the terms and conditions of em ployment. The proposed Employment Action Review Or dinance will provide a limited waiver of sovereign immunity to allow tribal employees to have judi cial review by the Tribal Court of final employ ment decisions. No action or decision shall be con sidered a "final employment decision" until and unless the employee has exhausted available re view procedures. The waiver of sovereign immu nity only applies to judicial reviews conducted by the Tribal Court of the Confederated Tribes of Grand Ronde. The purpose of the Ordinance is to enhance the employment relationship between the Tribe and tribal employees and to provide a forum in which tribal employees may file for judicial re view of final employment decisions. For purposes of this Ordinance, employees shall include all em ployees working for the Confederated Tribes of Grand Ronde, Spirit Mountain Development Cor poration, Spirit Mountain Gaming Inc., and the Grand Ronde Tribal Housing Authority. Decree Changing Name Based on the allegations set forth in the petition for change of name filed by the Petitioner in the above entitled case and its supporting affidavit, THE COURT FINDS: 1. The Petitioner is over 18 years of age; 2. The Petitioner is an enrolled member of the Confederated Tribes of the Grand Ronde Commu nity of Oregon; 3. The Petitioner has not petitioned and been granted a change of name by the Tribal Court within the past twelve (12) months; 4. All persons entitled to notice have been prop erly served with a copy of the Notice for Name Change, and; 5. No objection to the petition has been filed by any creditor or former spouse of the Petitioner. Based on the foregoing findings, THE COURT DECREES: 1. That the name of the Petitioner be changed from Suzanne Dionne Ducharme (Zimbrick) to Violet Suzanne Dionne Ducharme (Zimbrick); 2. That the Clerk of the Tribal Court shall cause a copy of this order to be published in the Tribal Newsletter; 3. That the Clerk of the Tribal Court shall submit a certified copy of this order to the Tribal Enroll ment office; 4. That the Petitioner shall surrender all old Tribal Identification Cards bearing Petitioner's former name to the Tribal Enrollment Office prior to the Enroll ment Office issuing Petitioner new Tribal Identifi cation Cards bearing the Petitioner's new name; 5. That within sixty (60) days from the date of this order the Tribal Enrollment staff and if necessary the Tribal Enrollment Committee shall cause new Tribal Identification Cards to be issued to Petitioner showing the new name of the tribal member and shall change the official membership roll and all official enrollment records of the Tribe to reflect the Petitioner's new name as stated in this Decree; 6. That the Oregon Department of Vital Statistics is authorized to issue a new birth certificate to Pe titioner in such form as to indicate that her new maiden (birth) name is Violet Suzanne Dionne Ducharme. Amended Order Granting Name Change Based on the allegations set forth in the petition for change of name and new birth certificate juvenile filed by the Petitioner in the above entitled case and based on the Court's examination of the Applicant, the Petitioner and other interested par ties'at the Show Cause Hearing held on November 18, 1997, THE COURT FINDS: 1. The Petitioner is over 18 years of age and is the parent or legal guardian of the Applicant, a minor child; 2. The Applicant's mother is an enrolled member of the Confederated Tribes of the Grand Ronde Community of Oregon; 3. The Applicant has not petitioned and been granted a change of name by the Tribal Court within the past twelve (12) months; 4. All persons entitled to notice have been prop erly served with a copy of the Notice to Parents and Legal Guardians; 5. No objection to the petition has been filed by any parent or legal guardian of the minor child and no objection was raised at the Show Cause Hearing; and 6. The proposed name change is in the best inter ests of the minor child; 7. The father has consented by stating under oath that he consents to the change. 8. The biological father of the Applicant misled the biological mother as to his true and legal name; 9. The true and legal name of the biological father is and at all times was Jerrid Anthony Meagher, not Atiaus Cougar Hayes; 10. The requested full name of the Applicant is Jackalyn Serene Meagher. Based on the foregoing findings, THE COURT ORDERS: 1. That the name of the Applicant be changed from Jackalyn S. Hayes to Jackalyn Serene Meagher; 2. That the Clerk of the Tribal Court shall cause a copy of this order to be published in the Tribal Newspaper; 3. That the Clerk of the Tribal Court shall submit a certified copy of this order to the Tribal Enroll ment office; 4. That the Clerk of the Court shall provide Peti tioner with a certified copy of this Order to be sub mitted by Petitioner to the Registrar of Vital Statis tics in the state which the Applicant was born; 5. That upon receipt of the certified copy of the Amended Order Granting Name Change, the Reg istrar shall issue a new birth certificate of the Ap plicant to reflect the new name of the Applicant as stated in the Amended Order and the Name of the father as Jerrid Anthony Meagher and shall change any designation of race or national origin on the birth certificate to reflect that the Petitioner is American Indian; 6. That the Petitioner, on behalf of the minor child shall surrender all old Tribal Identification Cards bearing Petitioner's former name to the Tribal En rollment Office prior to the Enrollment Office is suing Petitioner new Tribal Identification Cards bearing the Petitioner's new name; and 7.
