Smoke Signals July 1991 1 page 6 1991 TRIBAL HUNTING INFORMATION RETURN OF TAGS AND FORMS According to the agreement between the Tribe and State, the Tribe is required to submit an annual Fish and wildlife report to the Oregon Department offish and Wildlife. Therefore, tribal tags and receipts for non-kills, tag receipts with the kill information section completed for those who successfully Till their tags and all reports of lost tags must reach the Tribal Fish and Wildlife Program no later than the established deadlines. Deadlines will vary due to hunt schedules. To insure the maximum utilization of the tribal tags remember that failing to return your tag report kills or lost tags could result in other tribal members not being able to hunt. Also, failure to return tags, report kills or lost tags, or any other state or tribal violations may result in penal ties. Tribal penalties may include at least one year loss of tribal hunting privileges. (The following information is from the tribal Hunting, Fishing and Gathering Handbook.) 1. GENERAL: Each year, the State of Oregon shall issue 395 deer and elk tags (not to exceed 45 elk tags) and 5 bear tags to the Tribe for tribal hunting. "Tribal hunting" shall mean hunting pursuant to a hunting license issued by the , Tribe. 2. WHO MAY ENGAGE IN CULTURAL HUNT ING: No person shall engage in tribal hunting except a tribal member who possesses a current tribal license, a valid annual hunting sticker and the appropriate deer, elk or bear tag issued by the Tribe. Any tribal member who is bv tribal, federal or state law, prohibited from having in possession, or using, a firearm shall not be eligible for tribal hunting taps for those hunts which would result in a violation of that prohibition. 3. SEASON: The season for tribal deer, elk and bear hunting shall be those prescribed by the state for all citizens in the tribal hunting and fishing area. 4. STATE REGULATIONS TO APPLY: Weapons, antler regulations, methods of taking and other state regulations about taking shall apply to tribal hunting by tribal members. 5. TAGS: The Fish and Wildlife Committee shall issue the tags as follows: Annually, the committee shall publish hunting tag application forms in the tribal newsletter. Please read all regulations carefully. If an application for a tag is filled out improperly, it will not be consid ered valid and will not be entered 'into the tag drawing. The deadline for submitting the tag applica tion shall be published in the tribal newsletter along with the drawing date. A. DEER TAGS SHALL BE ISSUED AS FOL LOWS: Five deer tags shall be reserved for cultural gatherings approved by the Tribal Council. Bow deer, general deer and muzzleloader deer taps will be available on a first come, first serve basis as long as the supply lasts. Tribal members will be issued one deer tag at a time. For instance, if vou have a bow deer tag, vou will be ineligible to receive a general deer tag until the bow deer tag is returned or a kill reported. Deer tags must be returned bv the established deadline or a kill re ported in order to receive any additional taps. B. ELK TAGS SHALL BE ISSUED AS FOL LOWS: One elk tag shall be reserved for cultural gathering approved by the Tribal Council. The remaining elk tags shall be issued to interested, licensed tribal members who register for a drawing to be conducted by the committee. The first 23 of said tags shall be issued to the people whose names are first drawn for use in the state's first established season. The remaining 13 of said tags shall be issued to the people whose names are next drawn for use in the state's second established season. C. BEAR TAGS SHALL BE ISSUED AS FOL LOWS: One bear tag shall be reserved for cultural gatherings approved by the Tribal Council. The remaining bear tags shall be issued to interested, licensed tribal members who register for a drawing to be conducted by the committee. The tags shall be issued to the people whose names are drawn first for use in the state's established season. D. TRANSFERABILITY: A tag may be transferred by the tribal member to whom it was issued only to another licensed tribal member; however, the first tribal member is still responsible for returning the tag or reporting the game taken within the time limits set. Any unused tag may be turned back to the committee for re-issuance to another licensee. Tribal members who transfer a deer, elk or bear tag to a tribal member who has lost their hunting privileges will be subject to penalties. (Tribal members should check to make sure the person their tag is transferred to has the appropriate annual sticker on the back of the I.D. Card.) E. REPORTING: When reporting a kill or returning a tag not filled, members must also return the hunting tag receipt with the kill information section completed. The holder of a first season or second season hunt elk tag shall report any kill or return an unused tag within 24 hours of the end of the respective season. The holder of a bow deer, general deer or muzzle loader deer or bear tag shall report any kills or return any unused tags to the committee within two weeks of the end of the respective hunt, The holder of a controlled hunt or damage hunt tag shall report anv kill or return unused tags according to the established deadline on the tag receipt form which shall be no later than two weeks following the end of the respective hunt. Lost tags must be reported immediately.. Lost tags reported after the designated deadline mav result in tribal penalties. 6. FJJGffillJTY: No hunting tag shall be issued to any young person between 12 and 18 years of age unless that person possesses a safety certificate approved by the committee. A Hunter Education Certificate issued by any state is deemed to be an approved safety certificate. The person must have the certificate in his or her possession while hunting. No hunting tag shall be issued to any person under the age of 12 under any circumstances. 7. CONTROLLED HUNTS: Controlled hunt tags or damage hunt tags issued to the Tribe shall be valid only when used in combination with an unused general season tag issued by the Tribe. 8. TAKING OF OTHER THAN DEER, ELK OR BEAR PROHIBITED: There shall be no taking of animals other than deer, elk or bear as part of the tribal hunting privileges. 9. STATE TRESPASS LAWS TO APPLY: . State trespass laws and other laws governing rights of landowners and tenants shall apply to all tribal hunting. 10. NO COMMERCIAL USE: No deer, bear or elk taken with a license issued by the Tribe can be used for commercial purposes. 11. HUNTING OUTSIDE THE DESIGNATED AREA: The taking of deer, elk, or bear in a geographic area other than the established tribal "hunting and fishing" (Trask Management Unit) is prohibited. 12. NO STATE TAG WITH TRIBAL I J). CARD: No tribal member shall purchase a state deer, elk or bear tag to use with their tribal hunting license. (I.D. Card with appropriate annual sticker on back).
