VIOLATIONS
1. ) RELATIONSHIP TO STATE LAW
It is the intent of the Tribe to fully uphold the Agreement
with the State. Accordingly, any tribal member shall be
subject to state regulations and penalties if:
a. The tribal member does not have a valid tribal license
and a valid applicable tag in possession.
b. A tribal member has not properly filled out a tag and
affixed it to the animal; or
c A tribal member has not compiled with all other state
tagging, possession and transportation regulations not
inconsistent with the Agreement.
2. VIOLATIONS
Any failure to follow tribal regulations shall be a violation.
Any tribal member aware of a violation of tribal regulations
shall report it to the Committee in detail including a list of
any other witnesses. The report shall be signed by the
reporting member.
It is the intent of the Tribe to establish a tribal court as
required in the Tribes' Constitution. Upon said establish
ment, the Tribal Council shall determine the extent to
which the court shall exercise authority over violations of
the Fishing, Hunting and Gathering Ordinance.
3. NOTICE OF VIOLATIONS
The Committee shall notify the tribal member of any
reported violation alleged to have been committed by him
or her. The notice shall be in writing and shall include the
following:
A) A statement of the facts constituting the alleged
violation;
B) The date, time, and place of the Committee's next
meeting; ,
C) That the tribal member may present any evidence
relevant to the alleged violations to the Committee at its
next meeting.
The notice shall be sent by certified mail to the members
last known address. If the notice is not accepted within five
working days, the Committee shall send a second notice by
certified mail. The second notice shall state, in addition to
the information in the first notice, that it is the final notice
and that the Committee shall proceed with action on the
alleged violations.
4) CONSIDERATION BY COMMITTEE
The Committee shall consider the facts and nature of the
alleged violation and all reliable evidence regarding it. The
Committee shall make its findings regarding the alleged
violation in writing with supporting reasons.
5) SUSPENSION OR REVOCATION OF
PRIVILEGES
If the Committee finds that the Tribal member has com
mitted a violation, it shall suspend or permanently revoke
the member's hunting, fishing, andor gathering privileges.
The Committee shall consider whether the violation is the
member's first in deciding the length of the suspension and
' whether to revoke privileges.
6) RECONSIDERATION
In its discretion, the Committee may reconsider its findings
at the request of the member. The member must make
such a request in writing with supporting reasons within 30
days of notice of his or her suspension or revocation of
privileges.
7) APPEAL
The member may appeal the Committee's decision to the
Tribal Council based on the record of the Committee's
meeting at which the violation was considered, provided,
however, that the Tribal Court shall handle such appeals
once the Tribal Council empowers it to do so. The appeal
must be in writing with supporting reasons and made within
14 daysof the Committee's action. The Tribal Councilmay
pardon the member, reverse the Committee's decision, or
decrease the extent of the suspension or revocation as
just ice requires. The decision of the Tribal Council shall be
final.
8) PARDON
Any member whose privileges are permanently revoked
may request that the Tribal Council pardon him or her after
three (3) years from the date of revocation.
