NCAI opposes proposed McGirt legislation
The nation's largest inter-
tribal advocacy organization
is diving into controversy
over the U.S. Supreme Court
decision that affirmed the
treaty rights of the
Muscogee—Creek Nation,
vowing to oppose legislation
aimed at undermining the
historic victory.
In a statement last week
the National Congress of
American Indians acknowl-
edged efforts on Capitol
Hill to “disestablish or ter-
minate” reser vations in
Oklahoma following the
landmark win in McGirt v.
Oklahoma. But the organi-
zation said it would “ag-
gressively oppose this base-
less action.”
“NCAI’s mission is to
fully protect and support the
sovereignty of every tribal
government across the
countr y,” the short yet
pointed statement read.
“As such, we will strongly
oppose any and all legisla-
tion that diminishes the sov-
ereignty, jurisdiction, or
treaty rights of tribal nations
that are affirmed in the
United States Constitution,
statutes, and judicial opin-
ions, including in the Su-
preme Court’s historic
McGirt decision.”
The statement capped
off days of political drama
that began when the
Muscogee—Creek Nation,
whose reservation bound-
aries in Oklahoma were con-
firmed through the case,
walked away from potential
legislation that might ad-
dress issues arising from
McGirt.
The tribe and its leaders
have made clear that they
will not accept any efforts to
erode their sovereignty.
“Creek Nation is com-
pletely against any legislation
that diminishes McGir t,”
Jonodev Chaud-huri, a
former federal government
official who now serves as
his tribe’s ambassador, said
during a well-attended
webinar that concluded right
as NCAI was issuing its state-
ment.
Derrick Beetso, NCAI’s
general counsel, also took
part in the session, which was
hosted by the Indian Legal
Program at the Sandra Day
O’Connor College of Law at
Arizona State University. He
called McGirt a “huge vic-
tory on behalf of Indian
Country” that should not be
attacked in the halls of the
U.S. Congress.
“NCAI will stand strong
against that,” Beetso, who is
a citizen of the Navajo Na-
tion, said in a preview of the
organization’s eventual state-
ment, which points back to
its 76-year history as a de-
fender of sovereignty and
opponent of termination-era
policies such as taking away
tribal homelands.
Stacy Leeds, dean emeri-
tus and professor of law at
the University of Arkansas,
said she’s heard about a leg-
islative rider that could di-
minish not just the home-
lands of the Muscogee—
Creek Nation but those of
the Cherokee Nation, the
Chickasaw Nation the
Cherokee Nation, the
Choctaw Nation and the
Seminole Nation, who are
sometime collectively known
as the Five Civilized Tribes.
