Spilyay Tymoo, Warm Springs, Oregon July 6, 2016 BIA hopes to reach land-to-trust goal The Bureau of Indian Af- fairs has taken 416,000 acres into trust since President Barack Obama came on board, Interior Secretary Sally Jewell said on Wednesday. The agency hopes to hit 500,000 acres before Obama leaves office in January 2017, Jewell told the National Con- gress of American Indians at its mid-year conference in Spokane, Washington. “These lands will make your nations whole again,” Jewell said. Tribes complained that the land-into-trust process nearly ground to a halt during the Bush administration. In hopes of ensuring that tribes wont be left out in the dark whoever comes on board in just a few months, the BIA released a new Fee- to-Tr ust Handbook on Thursday. Larry Roberts, the leader of the agency, said the changes will help streamline the process. “After hearing from tribal leaders, we have taken another step in reducing lengthy and burdensome processes that hinder tribal governments in more fully utilizing their lands for the betterment of their people,” Roberts said. “The BIA’s revisions to its Fee-to-Trust Handbook pro- vide tribes with greater flex- ibility in submitting land-into- trust and reservation procla- mation requests while reduc- ing the time spent to process them.” One key change allows tribes to combine their land- into-trust and reservation proclamation applications. Previously, they had to wait until their land was placed in trust before seeking a proc- lamation. The U.S. Supreme Court won’t be wading into a controversial labor sov- ereignty dispute that af- fects tribal casinos nation- wide. The justices issued or- ders last week declining pe- titions in Little River Band of Ottawa Indians Tribal Government v. NLRB and Soaring Eagle Casino and Resor t v. NLRB. That means the Little River Band of Ottawa Indians and the Saginaw Chippewa Tribe, both from Michi- gan, won’t be able to ar- gue that their gaming fa- cilities should be exempt from the National Labor Relations Act. Law professor Matthew L.M. Fletcher, the director of the Indigenous Law and Policy Center at Michigan State University, said that he wasn’t surprised by the court’s move. Had the jus- tices accepted the cases, he predicted it could have led to a 4-4 tie. The Supreme Court dead- locked in Friedrichs v. Califor- nia Teachers Association, a high-profile labor union case, in March due to the absence of Justice Antonin Scalia, who died in February. His vote would have tipped the case in another way. The court also deadlocked on Dollar General Corpo- ration v. Mississippi Band of Choctaw Indians, a closely- watched tribal jurisdiction case. In that situation, the tie benefited the Missis- sippi Band of Choctaw Indians because it af- firmed a lower court rul- ing in the tribe's favor. The same would not be true for the Michigan tribes because because the 6th Circuit Court of Appeals ruled against them. A tie would merely af- firm that decision although it would not set a nation- wide precedent.
