Support economic growth
through a tribal UCC
By Lucinda Hughes-Juan

Throughout recent years,
many tribal nations have man
aged to build strong tribal
economies by way o f gaming
and other business enterprises.
They have created oppor
tunities to support business
partnerships and small busi
ness development.
D espite these successes,
the question still arises: “Are
tribes prepared to facilitate
business transactions across
tribal borders or to attract
outside investors to fund im
portant business projects?”
O ne way to address this is
for tribes to develop a con
sistent and standardized set
o f laws that help to govern
business transaction across ju
risdictions.
A U niform Com m ercial
Code (UCC) is a set o f laws
that apply to these types o f
secure business transactions.
They include laws that ad
dress loans and extensions o f
credit that involve collateral.

A Standard Uniform Com

lished by the N ational C on

(NCCUSL) and became U.S.
law in the early 1970s. Most
free market economies today
have a secured transaction
system that legally supports
their economic development.
A tribal model o f a Uni
form Commercial Code en-
titled the M odel Tribal Se

d eveloped in 2005 by th e
NCCUSL. It was drafted by
a special committee that in
cluded an advisory group o f
Indian tribes from , am ong
o ther tribes, the C onfeder
ated Tribes o f Warm Springs.
“T h e code is m e a n t to
serve as a model; tribes can
use it to develop their own
laws th at reflect th eir ow n
particular cultural and legal

Woodrow, w ho served as an
advisor to the drafting com
m ittee. T his along w ith its

development.

lenders and many investors
will only do business in an en
vironm ent that has a system
in place that lays out the rules
for these types o f secured
business transactions.
Warm Springs Construction will be working on the Hollywood Boulevard and Tenino intersection in the near
future. Meanwhile, a crew last week was correcting a storm-water drainage issue near the intersection, a
preliminary part of the overall project.
